국문 초록

오늘날 공동주택내에서 거주하는 입주민들의 쾌적한 주거생활을 위한 방안이 필요한 때이다. 최근에 공동주택 내에서 발생하는 각종 분쟁, 사건사고, 비리사고 등을 언론을 통하여 쉽게 접할 수 있는데 이는 이들이 이미 사회문제화되었다는 방증이다. 이러한 문제에 대한 해결책으로는 보다 근본적이고, 장기적인 방안이 필요한데 구체적인 해결방안을 모색하기 위하여 공동주택 내 입주민의 제반 권리를 통칭할 수 있는 헌법상 기본권으로서 “주거생활권”이라는 개념을 도출하고, 그 법적 성격을 종합적 기본권으로 판단하였다. 그러한 논의는 사회적 기본권성보다는 자유권적 기본권성이 권리구제측면에서 유리하기 때문에 실익이 있다고 하겠다. 구체적으로 입주민의 주거생활권을 향상시키기 위해서 커뮤니티를 활성화할 수 있는 방안이라든가, 공동주택 내 발생하고 있는 부정적인 요소 특히 각종 비리 등을 척결할 수 있는 방안을 제시하였다. 즉 공동주택 내 기관인 입주자대표회의와 관리주체의 상호 견제 및 균형이 상실되고 내부적인 감사기능을 상실한 현 시점에서 이런 제반 문제를 주민 자치적으로 해결할 수 없다고 판단하였다. 따라서 현 시점에서는 우선 주무관청의 체계를 향상시켜 각종 비리를 사전·사후적으로 예방하고, 장기적으로는 공동주택 내 기관들이 상호 통제, 감시, 견제할 수 있는 시스템 마련이 필요하다고 본다. 특히 국가적으로도 공동주택 내에서 발생하는 문제점에 대한 인식은 있으나 이에 대한 근본적이고 장기적인 방안을 제시하고 있지 못하고 있는 것이 현실이다. 따라서 앞으로 입주민의 쾌적한 주거생활을 통한 삶의 질 향상과 관련하여 헌법상 주거생활권의 개념 정의, 법적성격, 타 기본권과의 관계 특히 우월관계 등에 대한 깊은 논의가 필요하다고 보며, 실무적으로도 공동주택과 관련한 문제점들을 미연에 방지하고 사후적으로 해결하기 위하여 공동주택의 전문인력 관리제도 등의 도입이 필요하다고 하겠다.

영문 초록

The purpose of this study is to examine the comfortable residential living of residents in apartments. Recently, many media sources have reported that there are a variety of troubles, accidents, criminal cases and corruptions as an evidence of social problems concerning apartments. This study focused on suggesting the long-term, fundamental solutions to these problems. The study was performed by suggesting the concept of Residential Living Rights as the basic constitutional right that mean all he rights of residents living within apartments, and by considering their legal characters to be the comprehensive basic rights, in order to find out their constitutional basis or root needed to suggest individual legal solutions. Again, this study was carried out in details by suggesting methods for activating residents community in advance to improve residential living rights of residents and by finding methods for eliminating a variety of corruptions occurring within apartments, so as to improve residential living rights of residents. Under the current circumstances that there are no such functions as maintaining mutual check and balance between apartment managements and residents representatives and performing internal auditing, it seems to be impossible for residents to solve these problems autonomically. To solve the problems under such circumstances, it is required to strengthen the supervising power (control power) of related authorities to prevent a variety of corruptions occurring within apartments in advance or control them after occurrence, and to set up a system designed for mutual control and check between organizations within apartments, from the long-term viewpoint. Finally, it has been known that although there are a lot of problems within apartments all over the country, fundamental long-term methods have not been suggested so far. Accordingly, it is definitely required to carry out further studies on the concept of constitutional residential living rights, their legal characteristics and their relations with other basic rights (particularly, superiority relations), in order to improve the quality of life based on comfortable residential living of residents. Practically, it is also necessary to introduce a system (such as a system to employ apartment experts) that can prevent problems with apartments in advance and solve them after occurrence.
