미국 각 주의 청소년법정 법제 현황 분석 및 시사점

국문 초록

학생자치법정은 법무부가 중심이 되어 2006년부터 현재까지 학교, 소년원, 소년법원 등에서 시범·운영되고 있다. 학생자치법정은 미국 청소년법정을 모델로 삼고, 한국적 상황에 맞게 도입하는 것으로 상벌점제를 전제로 한 법교육프로그램의 일종이다. 최근 학생자치법정에 관한 법제화 논의가 제기되고 있어, 이 연구는 우리나라 학생자치법정이 모델로 삼고 있는 미국의 청소년법정에 관한 법제 현황을 분석하고 우리나라 법제화에 주는 시사점을 도출해 보고자 하였다. 미국의 경우 총 51개주(총 50개 주와 워싱턴 D.C 포함) 중 약 25개 주에서 법제화하고 있고, 법제화의 수준도 형사소송법, 소년법, 교육법 등 다양하며, 상세화의 정도에 있어서도 천차만별이다. 청소년법정은 소년범에 대한 다이버전 프로그램의 성격을 가진다는 점에서 우리나라 학생자치법정이 학생을 선도하고자 하는 교육적 목적의 활동이라는 점에서 차이가 있다. 또한, 미국의 청소년법정은 주로 소년법원이나 지역 단체에서 운영되며 학교에서 운영되는 경우는 상대적으로 적다는 점에서도 우리와 차이가 있다. 따라서 미국의 청소년법정이 법제화된 경우가 있다고 하여, 우리나라에서도 이를 법제화할 것인지 여부는 좀 더 많은 논의와 검토가 필요하다고 판단된다. 정부는 학생자치법정이 잘 운영될 수 있도록 학생자치법정 매뉴얼 개발·보급에 중점을 두고, 학교에게 자율적으로 학생자치법정을 운영할 수 있도록 지원하는 것이 타당하다.

영문 초록

This study research that the method with enactment for activating and expanding of the student court program in Korea which ministry of justice have carried out since 2006. To advance the discussion about enactment of the student court, this study analyze the current law system of the teen court in united states of America as model of the Korea s student court. Although the government try to enact into law of student court that sampled with teen court in U.S.A, it is difficult as modeling because the difference of legal nature between teen court as one of diversion programs in U.S.A and student court as one of law-related education program in Korea. Teen court s legal nature is more similar to Teen participation court in Korea than student court, but it looks like student court as law-related education on student s jury role. Due to these difference, it could be derive some implication like this,First, it might be too restrictive with legislation to flexible operate the student court which have already debated in U.S.A. In addition, the enactment of political dimension is more helpful for expanding and activation of the student s court as law-related education program such as after-school program in Korea. So, student court don t absolutely need to enact the law. Second, the school rules is preferred to lay the legal basis. Third, the Government authorities have to develop the student court guidelines which is based on in-depth study and participated by law scholar, lawyer, teacher and so on. Finally, the most important thing is that the corporation of Ministry of Justice, Ministry of education, Science, and technology, the provincial education office through the establishment of a co-pilot operating system and support for teachers and student s training and give grants.
