실종자 업무처리에 관한 문제점과 개선방안에 관한 논의

국문 초록

이 연구는 실종사건 처리의 효율성을 기하기 위하여 실종자 업무처리 과정에서 나타나는 문제점을 확인하고 그에 대한 개선방안을 모색하기 위해 진행되었다. 연구의 목적을 달성하기 위하여 실종자 업무처리에 관한 법령에 대해 검토하였으며, 실종현황 분석을 통해 실종사건의 특징을 확인하였다. 나아가 실종자 업무처리 과정과 관련 프로그램에 대해 검토하였다. 연구결과 성인실종자와 관련한 사회적 문제가 지속되고 있음에도 불구하고 입법적 결함으로 인해 제도적 지원이 제한되고 있는 점, 경찰조직 내의 실종자 업무처리 과정상 나타나는 문제로 업무분장 및 전담수사기구의 구성과 운영이 미흡한 점, 업무과중 등에 따른 잦은 인사이동으로 전담인력의 전문성 확보가 어려운 점, 실종 예방과 실종자 발견을 위해 운영되는 프로그램의 실효성 확보를 위한 노력이 필요한 점 등이 문제로 확인되었다. 연구자는 이러한 문제에 대한 개선방안으로 보호 및 지원대상에 성인실종자를 포함하는 법률적 근거마련과 효율적 인력운용을 위한 위험성 평가지표의 구체화, 실종업무 및 피해자에 대한 지원이 종합적으로 이루어질 수 있는 범정부 차원의 전담기구 설치, 전문인력 확보를 위한 조건부 채용 및 교육훈련의 체계화, 시민의 참여를 담보할 수 있는 인식개선 방안 등을 제시하였다.

영문 초록

This study was conducted to identify the problems that arise during the process of missing persons work and to find ways to improve them in order to improve the efficiency of handling missing persons. The results of the study are as follows: First, although social problems related to adult missing persons continue, institutional support is limited due to legislative defects. Second, it is a problem that occurs in the process of handling missing persons in the police organization. The composition and operation of a dedicated investigation body are insufficient. Third, it is difficult to secure the expertise of dedicated personnel due to frequent personnel movements. Fourth, it is necessary to have a means to secure the effectiveness of the program operated to prevent disappearance and to find missing persons. To address these issues, the following alternatives were proposed: First, it is necessary to prepare laws including adult missing persons and to provide more detailed risk assessment indicators. Second, it is required to establish a dedicated organization at the pan-government level so that the work related to missing persons and support for victims can be comprehensively carried out. Third, conditional recruitment system and systematic education and training courses should be prepared to secure professional manpower. Finally, in order to secure the effectiveness of the program in operation, a plan to improve the awareness that can induce active participation of citizens should be prepared.
