한‧중 사이버테러 대응체계 비교연구

국문 초록

사이버 기술의 선진화는 현대사회에 수많은 이점을 가져다주었지만, 더불어 사이버테러와 같은 범죄도 점차 진화하고 있다. IT 선진국인 한국과 중국은 사이버테러에 관한 법률ㆍ조직ㆍ교육 등의 대응체계를 강화해나가고 있으며, 각국 대응체계에 따라 다른 강점들이 존재하고 있다. 이러한 특징에 따라, 본 논문은 양국 사이버테러의 대응체계를 비교할 것이며, 다음과 같은 시사점을 도출하였다. 첫째, 한국은 중국의 ‘체계적인 법률’처럼, 사이버테러 관련 기본법 신설하고 처벌 규정을 재정립할 필요가 있다. 반면 중국은 한국의 ‘명확한 규정’이라는 이점에 따라, 처벌에 관한 법조문을 명확하게 규정할 필요가 있다. 둘째, 한국 ‘실무부처 중점 대응조직’과 중국 ‘컨트롤타워 중점 대응조직’의 장점을 바탕으로, 평상시에는 실무부처 중점의 조직체계를 이루어 전문성을 강화하고, 긴급 상황 시에는 컨트롤타워 중점의 조직구조를 갖춰 사이버테러에 빠르게 대응할 수 있어야 한다. 셋째, 한국은 중국의 ‘사이버안보 정규과목’처럼, 정규 수업을 통해 기본 교육체제 강화 및 인식 제고에 힘써야 한다. 또한 중국은 한국의 ‘다분야 인재양성’과 같이, 인재양성 전문기관을 증설하여 다양한 분야의 전문성을 증진하여야 할 것이다.

영문 초록

The advancement of cyber technology has brought many benefits to modern society, but in addition, cyber terrorism is gradually. Korea and China, which are advanced IT countries, are strengthening their response systems such as law, organization, and education on cyber terrorism, and different strengths exist depending on their response systems. In response to these characteristics, this papers will compare the response systems of cyberterrorism between the two countries and derive the following implications: First, Korea needs to establish a basic law on cyber terrorism and redefine punishment regulations, just like China s systematic law. In addition, China needs to clearly define the legal text on punishment in accordance with the advantage of South Korea s clear regulations. Second, based on the advantages of Korea s working-level response organization and China s control tower-focused response organization , it should strengthen its expertise by forming a working-level organizational system, and in emergency situations, it should be able to respond quickly to cyber terrorism. Third, Korea should strive to strengthen its basic education system and raise awareness through regular classes, just like China s cybersecurity regular course. In addition, China should expand specialized institutions for human resource development, such as Korea s various areas, raise competent people to promote professionalism in various fields.
