국문 초록

4차산업혁명 위험관리 정책과 법제는 4차산업혁명 국가정책 방향과 구체적 연관 속에서 검토해야 할 것이다. 4차산업혁명을 혁신성장의 추진계기로 삼되, 사람중심이라는 핵심표지를 함께 설정한 정책방향은 기술이란 도구 자체보다는 인간과 기술이 서로 맺는 관계가 핵심이라는 점에 대한 깊이 있는 통찰이 바탕에 깔려 있기 때문이다. 특히 4차산업혁명 위험관리 정책과 법제는 지속가능발전목표와 연계함으로써 국제적이면서 국내적인 맥락을 확보할 수 있다. 4차산업혁명 위험관리 내지 안전정책은 첫째 소관부처마다 상이하거나 중복된 법령이나 기준을 체계적으로 정비하는 일로부터 시작되어야 한다. 유관법령 및 기준 정비는 부처별 안전관리 기능강화에 기본일 뿐만 아니라, 정비과정에서 유관산업 발전과 국민안전 조화 방향으로 정책개선을 도모할 수 있다. 둘째, 4차산업혁명과 관련한 정부 규제와 감독 또한 혁신적이어야 할 것인데, 단순히 완화하거나 강화할 문제가 아님은 물론이다. 부적절한 안전관련 규제라면 폐지 또는 완화할 것이며, 효과적 처벌규정이 필요하면 신설 또는 개정해야 한다. 형식적 안전점검 및 안전관리 감독체계 부적절 문제야말로 4차산업혁명을 계기삼은 혁신이 필요한 부분이다. 셋째, 4차산업혁명 위험관리정책에서도 전략과 과학이 필요하다. 위험예방과 관리정책간 우선순위와 연계성을 전략적으로 고려해야 하고, 정책기획과 성과평가 또한 실증적 기반 위에서 수행되어야 한다. 무엇보다도 4차산업혁명의 긍정적, 부정적 측면에 대한 입체적이고 종합적인 대응을 위한 정부의 역할, 그리고 국민 안전과 국가 안보 측면에서 사이버보안 법제 개혁성과가 기대된다. 4차산업혁명의 핵심기술, 즉 인공지능, 사물인터넷, 자율주행차, 스마트시티 등은 네트워크 기반으로 실현되기 때문이다. 현 정부가 표방하는 사람중심 4차산업혁명의 법제개혁을 대하는 정책결정자, 입법관여자, 그리고 전문연구자들은 4차산업혁명의 첨단기술이 내세우는 스마트한 외관이나 장밋빛 전망보다는 사람의 삶, 삶의 질에 대한 근본적 관심에 바탕을 두고, 4차산업혁명 과학기술과 산업실태와 법적지원 및 규제정책을 實事求是의 태도로 차분히 접근해야 할 것이다. 이러한 태도를 가장 뚜렷이 요하는 부분이 바로 4차산업혁명 위험관리 및 안전법제인 것이다.

영문 초록

This essay examines policies and legislation for risk and crime control in the age of the 4th Industrial Revolution. As physical, digital, and biological worlds continue to converge, governments will increasingly face pressure to change their current approach to policymaking, as their central role of conducting policy diminishes owing to new sources of competition and decentralization of power that new technologies make possible. South Korean government proposes its own policy as people-oriented 4th industrial revolution, ‘Realization of People-Centered Fourth Industrial Revolution, Participated in by All and Enjoyed by All’, which aims to promote human value while to prevent risk of technology and social problems. Also, as for the value of the 4th Industrial Revolution law and policy, the Sustainable Development Goals can be one of the blueprint to achieve a better and more sustainable future. They address global challenges by the 4th Industrial Revolution, including poverty, inequality, climate change, environmental degradation, peace and justice. So government policies are to be developed to create diverse new industries through intelligent technology innovation and strengthen major industries, to improve people’s quality of life by resolving chronic social problems, to strengthen the social security net in preparation for changes in the job market, and to develop intelligent technologies, data, and networks accessible to all. The comprehensive policies of risk control and safety in the age of the 4th Industrial Revolution should be made as follows: Firstly, each government authority may has its own law and policy on individual issues, but such laws and policies should be reformed in systematic ways for more effective and efficient measures. Secondly, government regulation system on newly-developed industries should be reformed. Outdated regulation should be repealed, but tightened regulation also be considered to prevent risk and to protect people from any anticipated harms and side-effects. Above all, risk prevention and control system, which are not working is the first target to reform. Thirdly, such law and policy needs its own strategy and tactics. Each policy should be designed in cooperative way with principles on the priority, and should be followed by policy evaluation based on positive data. Risk-control law and policy in the matter of human security and national security demands the role of government in pursuing safety both in reality and cyberspace. That is why a comprehensive national strategy of cyber-security is needed in the age of the 4th Industrial Revolution.
