온라인 성착취 범죄와 사이버 강간에 관한 고찰

국문 초록

인터넷 시대, 디지털 시대, 메타버스 시대에 디지털 성범죄 또는 사이버강간(cyber rape)으로 불리는 다양한 형태의 성범죄가 논란이 되고 있다. 온라인상에서 피해자를 협박하여 피해자 스스로 자신의 신체에 추행을 하거나 물건을 삽입하게 하고 이를 사진이나 동영상으로 촬영한 후 전송하게 하는 성착취 범죄(sextortion)의 경우, 외국에서는 이를 강간죄의 개념에 포섭할 수 있는지가 문제되고 있다. 이러한 사례는 우리 형법상 강제추행죄나 유사강간죄의 직접정범은 될 수 없으나, 피해자를 도구로 하는 간접정범을 인정할 수 있다. 근래 비대면의 온라인 성범죄 또는 디지털 성범죄가 늘고 있으며 그 피해자의 상당수가 미성년자들임을 고려할 때, 간접정범 개념의 적극적 해석을 통하여 이러한 온라인 성범죄에 대응할 필요가 있는 것으로 판단된다. 현실세계가 아닌 가상공간(virtual world)에서 타인의 아바타(avatar)나 캐릭터를 성적으로 유린하는 형태의 성범죄가 이루어지기도 한다. 이러한 사이버 강간(cyber rape)은 물리적인 신체의 침해가 발생하지 않으므로 법이론상 전통적인 강간죄 등 성범죄의 범주에 포함시키기에는 어려운 점이 있다. 현실세계의 범죄는 유형(tangible)의 물리적 해악(physical harm)의 발생에 중점을 두고 있기 때문이다. 그러나 캐릭터를 이용한 사이버 성폭행이 비록 신체적 침해와 해악 발생을 전제하는 전통적인 개념의 성폭행과는 다르지만, 피해자에게 정신적 고통을 야기한다는 점에서 해악의 발생을 초래하고 있으므로 법적 대책이 있어야 할 것이다. 가상공간에서 제2의 삶(second life)이 보편화될 메타버스 시대(era of metaverse)에는 온라인상에서 발생하는 새로운 형태의 침해행위를 규율하기 위한 법이론의 개발과 입법정책의 마련이 더 필요한 상황이라고 판단된다. 다만, 이를 범죄로 한다면 메타버스 시대의 가상공간의 특성을 반영한 새로운 패러다임의 범죄유형이 고려되어야 할 것이다.

영문 초록

In the Internet era, Digital era, and Metaverse era, various types of sexual offences called digital sex crimes or cyber rape are being debated. Sextortion is a crime in which a criminal threatens a victim online, compels the victim to molest himself or insert an object into his or her body, and then to take a photo or video and send it to the criminal. In foreign countries, it is questioned whether sextortion constitutes rape. In this case, the perpetrator cannot be the direct principal of the crime of forced indecent assault or quasi-rape under the Criminal Code of Korea. However, the perpetrator can be an indirect criminal using the victim as an intermediary. Considering that online or digital sexual offences are on the rise in recent years, and many of the victims are minors, it is necessary to respond to these online sexual offenses through an active interpretation of the concept of indirect principal. Sexual offenses in the form of sexually abusing other users’ avatars or characters in a virtual world are also committed. Since cyber rape does not involve any physical harm, it is difficult to include it in the category of sexual offenses such as traditional types of rape. This is because real-world crimes focus on the tangible physical harm. Cyber sexual assault using a character or an avatar is different from the traditional concept of sexual assault, which presupposes physical intrusion and harm. However, cyber sexual assault also causes harm in that it causes psychological pain to victims, so there is a need for punishment. In the era of Metaverse, when the second life in a virtual world will become common, the development of legal theories and the preparation of legislative policies are more necessary to regulate new forms of online sexual crimes. However, if this is a crime, it is necessary to consider a new model of crime that reflects the characteristics of the virtual space of the Metaverse era.
