형법 선택형 시험의 오류

국문 초록

이 글의 목적은 형법 선택형 시험도 법학의 연구영역임을 확인하고, 판례를 맹신하고 있는 선택형 시험의 오류를 알리며, 이에 대한 관심을 촉구하는데 있다. 형법 선택형 기출문제 중 아래 3가지 문장은 진위 여부가 논란이 될 수 있으므로 선택형 문장으로 부적절하다고 생각한다. 첫째, 정신장애자라도 범행 당시 정상적인 사물변별능력이나 행위통제능력이 있었다면 심신장애자가 아니다. 둘째, 결과적 가중범의 미수범 처벌규정은 존재한다. 셋째, 하나의 행위가 작위범과 부작위범을 동시에 충족할 수 있다. 선택형 시험은 불가피한 평가방법이다. 법학교육과 밀접하게 연계된 의미있는 형법 선택형 질문을 만드는데 형법학자들이 관심을 가질 필요가 있다.

영문 초록

The purpose of this article is to confirm that the criminal law multiple choice test is also a research field of law, and to inform errors of multiple choice test, which is blind to Supreme Court precedent, and to urge interest in it. The following three sentences can be controversial as to whether they are true or false, so I think they are inappropriate as a criminal law choice question. First, even a mentally disabled person is not a mentally physically disabled person if he or she had normal object discrimination or behavior control ability when committing a crime. Second, in the case of crime aggravated by results, there are rules on punishment for attempted offenders. Third, one act can satisfy both crime committed by active conduct and crime committed through omission at the same time. Multiple choice test is an inevitable evaluation method. Criminal law scholars need to be interested in making meaningful criminal law multiple choice test closely related to law education.
