국문 초록

2016년 일본에서는 ｢국외범죄피해자 조위금 등의 지급에 관한 법률｣을 제정하여 일정한자격을 갖춘 국외범죄피해자에게 경제적 지원을 실시하고 있다. 일본 역시 우리나라와 같이범죄피해구조금(a criminal injury relief fund)의 지급 대상을 국내범죄피해자로 한정하고 있었으나, 일본인 국외범죄피해자의 증가추세에 따라 범죄피해자에 대한 경제적 지원의 필요성이 점점 부각되었고, 이러한 배경 하에 사회 연대·공조의 정신에 입각하여 국외범죄피해자에 대해서도 경제적 지원을 실시하게 되었다. 이러한 일본의 변화된 상황은 국외범죄피해자에 대한 국가의 구조책임을 외면하고 있는 우리나라에 시사하는 바가 크다는 점에서 주목된다. 이에 일본 ｢국외범죄피해자 조위금 등의 지급에 관한 법률｣의 입법 과정과 법률의 주요내용 및 특징을 살펴본 후 마지막으로 우리나라에의 시사점을 모색해보고자 하였다.

영문 초록

In 2016, ｢The Act on Payment of Condolence Grant to Victims of Crime Abroad｣ has recently been established in Japan, which shall provide economic support to Japanese victims of crimes committed overseas who meet certain qualifications. Like the Republic of Korea, the Japanese Government restricted eli- gibility for ‘Criminal Injury Relief Fund’ to victims of crimes in the country. However, there is a growing emphasis on responding to the needs of economic support to the victims of crimes overseas, according to the spirit of social solid- arity and cooperation, with an increasing number of the Japanese victims of crimes while abroad. As a result, the Japanese Government has provided economic support to the victims of crimes abroad. It is noteworthy that this change in the Japanese circumstances has a great implication on South Korea, which ignores the State responsibility for rescuing Korean victims of crimes committed overseas. Therefore, the legislative processes, characteristics, and contents of ｢The Act on Payment of Condolence Grant to Victims of Crime Abroad｣ in Japan were re- viewed and some implications were discussed.
