국문 초록

경찰과 검찰 등 수사기관은 실체적 진실발견이라는 형사사법 즉 범죄수사의 목적을 이루기 위하여 전기통신사업자에게 그들이 보유한 개인정보제출을 요구하게 되는 경우가 빈번하다. 현행법상 수사기관은 전기통신사업법에 따라 이용자의 통신자료 제공을 요청할 수 있으며, 또한 통신비밀보호법에 따라 통신사실 확인자료 제공을 요청할 수 있다. 그러나 위와 같은 통신자료 제공 제도는 정보인권에 대한 인식이 증대되면서 헌법상의 영장주의, 정보자기결정권 등과 맞닿아 찬반논쟁이 심화되고 있다. 수사기관에 대한 불신 및 통신 사찰에 대한 우려는 충분한 보완장치, 실질적인 집행절차를 통하여 해결해야하는 문제이다. 따라서 이를 근거로 전기통신사업법 자체를 부정한다거나 범죄수사를 목적으로 하는 통신자료 제공을 금지해서는 안 될 것이다. 아울러 신속한 범죄대응과 효율적인 수사의 필요를 위하여 통신자료가 필요하고 그 효율성 또한 보장되어야 한다. 이에 전기통신사업자가 수사기관으로부터 통신자료 요청을 받은 경우 제공 절차에 관하여 형식적ㆍ절차적 문제만으로 논의할 것이 아니라 이용자의 정보자기결정권, 사생활의 최소 침해 등에 입각하여 실질적으로 접근해야할 것이다.

영문 초록

Police and prosecutors often demand the filing of their personal information to the telecommunications carrier in order to achieve the purpose of criminal investigation, which is the discovery of substantive truth. Investigative agency may request that a user provide communication data in accordance with the Telecommunications Business Act. In addition, it may request to provide communication fact data in accordance with the Communication Confidentiality Protection Act. However, the above-mentioned telecommunication data provision system is getting more and more controversial due to the increase in the awareness of information human rights and the warrants of the constitution and the right of information self-determination. The distrust of the investigation agency and the concern about the inspection are problems to be solved through sufficient complementary devices or practical enforcement procedures. Therefore, it should not be prohibited to deny the Telecommunication Business Law itself or to provide communication data for criminal investigation purposes. In addition, communication data are needed for the rapid response of crime and the need for effective investigation, and the efficiency of the communication data should be ensured. Therefore, when a telecommunication carrier receives a request for communication data from an investigative agency, it should not be discussed only in terms of formal or procedural issues, but should be practically approached based on the minimum self-determination of users and privacy violation.
