‘집단민원현장’에서의 민간경비운영 개선방안

국문 초록

안전에 대한 사회적 수요의 증대로 민간경비산업은 경찰의 치안 공백을 채워주는 역할을 하며 중요한 민간산업으로 자리를 잡고 있다. 그러나 아직도 경비업법은 많은 문제점을 내포하고 있으며, 개선을 필요로 하는 부분들이 존재하고 있다. 일부 경비업자들의 불법행위로 인해 「경비업법」은 「규제강화법」이라 불릴 만큼 불필요한 규제와 강제성을 지닌 조항이 많다. 지나친 규제나 처벌의 강화는 범죄예방의 순기능을 감당하고 있는 민간경비업의 위축을 가져올 수 있으므로 각종 규제를 합리적인 범위 내에서 완화하는 법 개정이 요구 된다. 이에 본 연구는 ‘집단민원현장’에서의 민간경비 운영실태 및 문제점에 관한 동향을 살펴보고, 관련 선행연구 및 사건･사고 기사를 통해 문제점을 도출하여 민간경비 운영에 관한 정책적･제도적 개선방안을 제시하였다. 첫째, 집단민원현장에서의 경비원 배치 및 폐지신고를 ‘경찰민원포털’ 신고로 일원화하여 배치명단 누락에 따른 행정처벌이 발생하지 않도록 한다, 둘째, 집단민원현장에 배치된 경비지도사의 선임 기준을 강화하여야 한다. 셋째, 집단민원현장의 유형별 특성을 고려한 지도·점검 매뉴얼을 체계화해야 한다. 넷째, 결격사유에 해당하는 경비원의 배치 단속을 강화해야 한다. 다섯째, 현장 지도·감독 시 비표를 활용하여 점검시간을 단축해야 한다.

영문 초록

With the growing social demand for safety, the private security industry has become an important private industry, serving to fill the police vacuum. However, the law still poses many problems, and there are areas that require improvement. Due to the illegal activities of some security guards, the Security Business Act has many unnecessary regulations and enforcement to the point where it is called the Regulatory Enhancement Act. Excessive regulations or penalties can lead to a contraction of the private security industry, which is responsible for the net function of crime prevention, so it is necessary to revise laws to ease various regulations to a reasonable extent. In response, this study examined the current status and problems of private expense operation at the collective civil service site and presented policy and institutional improvement measures for private expense management by drawing problems through related prior research, incidents, and accident articles. First, the report on the deployment and abolition of security guards at the collective civil petition site shall be unified into a Police Civil Petition Portal report to prevent administrative punishment from occurring due to omission of the deployment list. Second, the criteria for the appointment of security guidance officers deployed at the site of a collective civil petition shall be strengthened. Third, the guidance and inspection manual shall be systematized considering the characteristics of each type of civil petition site. Fourth, the crackdown on the deployment of security guards, which is a reason for disqualification, should be strengthened.. Fifth,, the inspection time shall be shortened by utilizing a checklist for on-site guidance and supervision.
