국문 초록

본 연구는 우리나라 FTA에서의 시청각공동제작에 대한 연구를 하고자 하였다. 이를 위하여 먼저 공동제작과 국제공동제작협정에 대한 개념적 이해를 하고자 하였으며, FTA협정문에 포함된 시청각공동제작에 대한 내용들을 자세히 살펴보고, 우리나라의 시청각공동제작협정에 대한 특징들에 대하여 연구하였다. FTA는 우리나라가 체결하여 현재 발효 된 FTA 중, 근거조항만을 포함한 FTA는 제외하고, 부속서 혹은 의정서를 작성하여 시청각공동제작에 대한 협정을 진행, 체결한 FTA를 선정하여 해당 내용에 대하여 살펴보았다. 우리나라 FTA에서의 시청각공동제작의 특징으로는 문화교류의 의미뿐만 아니라, GATS 협정 시 이에 대한 최혜국대우 면제 신청을 하지 않음으로 양자 간 협정인 시청각공동제작협정 체결 시 통상법적 문제가 발생할 수 있으며, FTA내에서의 시청각공동제작에 대한 협정은 이에 대응하기 위한 통상법적 조치로서의 의미를 가진다. 또한 국가 차원에서 국내 시청각 산업의 발전과 보호를 위한 환경적인 여건들을 마련함에 그 의미가 있다고 볼 수 있다.

영문 초록

This research is about the Audiovisual Co-production in FTAs. Especially focused on Korea’ FTAs. For this research, first, understanding the concepts of Co-production and International Co-production Agreement, second, reading the contents of the Audiovisual Co-production fall within FTAs in detail. And researching the characteristic of the Audiovisual Co-production in FTAs of Korea. This research choose three FTAs, ⅰ) excluded what it included just ‘built-in clause’, ⅱ) signed the Audiovisual Co-production Agreement by Annex or the Protocol. FTAs has meaning of promote cultural exchange among nations. Besides, when negotiated for GATS, Korea did not request on GATS to exempt from MFN(Most Favored Nation) of the Audiovisual Co-production Agreement. So, if want to enter into agreement with one or several nations, could be in legal problem by trade law. The Audiovisual Co-production Agreement in FTAs are signified a legal measure of trade law problem. Furthermore, it has important means of at national level provided the fundamental conditions for the development and protection of the domestic audiovisual industry.
