감염병 관리기관에서의 주민 참여에 관한 고찰

국문 초록

코로나 바이러스(COVID-19)에서 비롯된 감염병 관리는 현재 가장 활발하게 논의되는 주제이고, 법학도 예외는 아니다. 이러한 감염병 관리는 감염병 관리기관을 통해 통제할 수 있다. 이 중에서 감염병 관리기관으로 중요하게 기능하는 것이 바로 공공의료원이다. 공공의료원은 감염병으로부터 국민의 생명을 보호하기 때문에, 적절하게 감염병 관리가 이루어지기 위해서는 국민의 의사에 기반하여 설립 및 운영될 필요가 있다. 그러나 한국에서는, 감염병이 미치는 피해를 직접적으로 받는 국민이, 공공의료원의 설립, 운영, 폐지 등과 관련된 의사결정에 참여할 수 있는 제도가 공공의료원 관계 법률 내에 마련되어 있지 않다. 이러한 문제 때문에, 2020년 7월에는 2013년에 폐업한 진주의료원을 대신하여 설립될 서부경남권 공공의료원은 공론화위원회가 활용되었다. 그러나 공론화위원회는 행정절차법이나 다른 법률에서 규정된 절차가 아니기 때문에, 주민의 참여를 법적으로 보장해주는 제도라고 볼 수는 없어 새로운 주민참여 제도의 도입이 필요하다. 이러한 필요성에 따라, 본 논문은 공공의료원에 관한 의사결정에 주민이 적극적으로 참여할 수 있는 법제를 확립하는 것을 목표로 한다. 공공의료원에 관한 의사결정에 주민이 적극적으로 참여할 필요성에 대하여는 네트워크 이론(Network Theory)의 관점에서 논의하였다. 또한 공공의료원 법제에서 주민 참여 제도를 도입하는 방안에 대하여는, 독일의 계획확정절차(Planfestellungsverfahren)를 참고하였다. 이렇게 공공의료원에 관한 의사결정에 주민이 참여하는 제도를 마련한다면, 공공의료원이 보다 적절하게 감염병 관리를 할 수 있는 병원으로 기능할 수 있을 것이다. 또한 공공의료원의 감염병 관리 기능을 향상시킴으로써, 감염병으로부터 효과적으로 국민의 생명을 보호하는 것이 기대된다.

영문 초록

Infectious disease control caused by COVID-19 is currently the most actively discussed theme in legal science. And only by infectious disease control institutions, infectious disease control has been possible. Public medical center is the most important infectious disease control institution. For the effective infectious disease control, it would be necessary to establish and manage public medical center, based upon the people’s decision making, because public medical center is for protecting people’s life from the infectious disease. Korea has no legal institution in which resident citizen(who could be influenced by infectious disease directly) can participate in decision making on the establishment, management and closure of public medical center. To solve this problem, in July 2020, Public Deliberation Committee was made to establish public medical center in Western Gyeongnam area. The new one would replace Jinju medical center(which was closed in 2013). But Public Deliberation Committee(2020) can’t guarantee resident’s legal participation because it has not made by Administrative Procedures Act of Korea(2020) or other acts. To solve this legal problem, it would be necessary to legislate new resident-participation system. This article suggests to establish resident-participation legal system in which residents can participate actively in decision making on public medical center. The writer uses Network Theory to discuss about necessity of resident-participation in decision making on public medical center. To adopt resident-participation legal system about public medical center, this study takes example by Planning Approval Procedure in Germany(Planfestellungsverfahren)(1976). Though the establishment of resident-participation legal system, public medical center can function properly as infectious disease control institution. By improving infectious disease control of the public medical center, effective protection of people’s life from the infectious disease can be expected.
