국문 초록

최근 국가보안법 폐지 또는 개정문제가 여당과 시민단체들에 의해 공론화 광장으로 나왔다. 그렇다면 폐지론자들이 평가하는 국가보안법 최고의 독소조항은 어느 조항일까?. 제1순위 독소조항은 국가보안법 제2조와 제3조이고, 제2순위는 제7조, 제3순위는 제10조, 제4순위는 제6조, 제8조로 보인다. 그러나 국민정서상, 제1순위 보다는 제2순위인 국보법 제7조의 폐지를 전면에 내세울 것으로 예상된다. 북한이 사이버공간을 활용하기 시작한 것은 1996년 3월 해외단체인 ‘북미주 조국통일동포회의’를 통해 인터넷 홈페이지를 개설하면서부터다. 북한의 인터넷 활동 경로는 대남 선동기구 → 북한 운영매체 → 해외 종북 사이트 → 국내 종북 성향 사이트 → 국내 온라인 커뮤니티 → 국내 언론 등의 유포경로를 통해 심리전을 전개하고 있다. 본고는 국가보안법에 대한 헌재와 대법원의 판단을 분석하고 평가함으로써, 향후 법 집행기관의 수사실무에 도움을 주고자 하는 차원에서 집필되었다.

영문 초록

Recently, the issue of the abolition or amendment of the National Security Law has emerged as a public debate by the ruling party and civic groups. Which clause would be the best toxic clause evaluated by the abolitionists of the National Security Law? The first priority toxin clauses are Articles 2 and 3 of the National Security Law, and the second is seen as Article 7, the third as Article 10, and the fourth as Article 6 and 8. North Korea s use of cyberspace began in March 1996 when it opened an Internet homepage through an overseas organization called the “North American Reunification of the Fatherland”. North Korea s Internet activities are carried out through South Korean Propaganda Organization → North Korean operating media → overseas jongbuk site → domestic jongbuk propensity site → South Korean online communities → South Korean media outlets. This study was written to help law enforcement agencies in the future by analyzing and evaluating the judgments of the Constitutional Court and the Supreme Court on the National Security Law.
