국문 초록

본 연구는 그동안 중단된 남북교류협력을 재가동하기 위한 방안으로 법제 개선과 협력사업의 다변화와 다각화를 모색하는데 목적을 두었다. 특히 지난 2018년 4월 남북정상회담을 통해 체결된 「4.27 판문점선언」의 의미를 되새기고 한반도의 항구적이며 공고한 평화체제 구축을 위한 전략을 찾는데 중점을 두었다. 첫째, 남북교류협력의 다변화를 위한 법제 개선을 중시하였다. 「남북교류협력법」 상 사업주체의 확대, 인적교류를 간소화한 북한방문을 신고제로 완화, 협력사업의 다양화, 「남북협력기금법」 상 보험제도 개선, 「접경지역지원 특별법」의 실효성 활용을 강조했다. 둘째, 남북교류협력의 다각화를 위한 법적 전략을 강조하였다. 북한근로자의 남한지역 내 ‘평화산업단지’(가칭)와 같은 공단 입주방식의 남북공동 협력사업과 남북한 경제협력강화 약정(CEPA) 체결을 제안했다. 여기서 제시한 방안들은 대북 제재가 해제 내지 완화될 경우 새롭게 추진할 수 있는 사안들이다. 그동안의 남북교류협력 과정에서 제기되었던 법·제도적 주요 쟁점들을 해결하려고 한 것이며, 향후 남북 간 협력사업을 다양화하고 새로운 접근 방식에서 모색한 개선방안들로 구성되어 있다. 현 문재인 정부가 목표하고 있는 ‘한반도 신경제구상’과 ‘통일경제특구’ 제안들을 잘 연계한다면 남북교류협력의 새로운 모델 창출이 가능할 것으로 기대된다.

영문 초록

This study aims to improve the legal system and seek diversification and diversification of cooperation projects as a way to reactivate inter-Korean exchange and cooperation that have been suspended. In particular, the emphasis was placed on reminiscing the meaning of the “4.27 Panmunjom Declaration” concluded through the inter-Korean summit in April 2018 and finding a strategy for establishing a permanent and solid peace regime on the Korean Peninsula. First, legal strategies for the diversification of South and North exchange and cooperation were proposed including the expansion of business entities on the Act of South and North exchange and cooperation; deregulation of visiting North Korea simplifying personal exchanges into the report system; diversification of cooperative projects; enhancement of the insurance system on the Act of South and North Cooperation Funds; and practical utilization of ‘the Special Act on Support of Boarder.’ Second, the common cooperative project between South and North with the industrial complex such as ‘Peaceful Industrial Complex (tentatively named)’ of the North Korean Worker in the territory of South Korea, and Closer Economic Partnership Arrangement (CEPA) between the two were proposes as the legal strategies for the diversification of the South and North exchange and cooperation. These were intended to solve the main legal and system issues which had been raised during the process of the South and North exchange and cooperation. They contained the diversification plans of cooperative projects between the two and improvement plans that had been sought from new approaching methods. If ‘the New Economic Initiative of the Korean Peninsula’ which is aimed by the current Mr. Moon’s government and the proposals on ‘Special Economic Zone after Unification’ are well connected, new model is anticipated to be created for the South and North exchange and cooperation.
