중앙행정권한의 지방이양 지원기구에 관한 공법적 검토

국문 초록

일명 지방분권법으로서 지방자치분권 및 지방행정체제개편에 관한 특별법이 개정되어 그 중심 추진기구로서 자치분권위원회가 설치 운영됨으로써 실질적인 성과를 만들어 내고 있다. 그러나 자치분권위원회가 단지 5년의 한시적인 기간 동안만 존속하는 것으로 규정됨으로써 과연 지방분권 및 중앙권한 및 사무의 이양이 제대로 이행될 수 있을 것인가 하는 걱정을 남기고 있다. 자치분권위원회가 한시적으로 존재하는 기간만이라도 그 기능을 잘 발휘하게 하기 위한 조치들과 노력은 필요하다. 특히 지방이양비용평가위원회와 같은 지원기구의 설치 및 운영을 포함한 장기적이고 지속적인 권한 및 사무이양에 관한 연구 검토가 요망된다. 이 글에서는 지방이양비용평가위원회를 포함한 지방이양을 위한 지원기구를 중심으로 살펴본다. 프랑스의 사례를 참조한다면 지방이양비용평가위원회와 같은 지원기구는 그 필요성이 인정된다고 할 것이다. 다만 우리의 경우 이와 같은 기구를 현재와 같이 대통령 산하 자치분권위원회의 전문위원회로서 계속 존치시키는 데는 자치분권위원회의 한시적 성격 때문에 한계가 있으므로 그 위상 및 지속적인 존속에 관하여 새로운 방안을 마련하여야 한다. 지방이양비용평가 전문위원회는 지방재정 및 지방이양 비용평가 관련 전문가 12명으로 구성되어 있다. 지방분권법 시행령 제21조의 2 제3항에 의한 지방이양 비용평가위원회의 구성을 보면 중앙과 지방의 동수로 구성될 뿐만 아니라 지방정부의 대표가 그 위원장이 되도록 규정하고 있는 프랑스의 이양사무 비용평가위원회(CCEC)의 사례와는 대비되는 것을 알 수 있다. 한편 지방이양비용평가위원회의 지속적 존치 필요성이 있기 때문에 특별법인 지방분권법에 직접 그 근거를 명시할 필요가 있다. 자치분권위원회의 한시적 시간이 종료되기 전까지는 국회 내의 합의를 통하여 개정법을 마련하여야 할 것으로 보인다. 그 밖에 이 글은 지방이양비용평가위원회가 고려하여야 할 원칙도 포함하여 서술하고 있다.

영문 초록

The Special Act on Decentralization of Local Autonomy and Reorganization of the Local Administrative System, also known as the Local Decentralization Act, was revised, and the Committee for Autonomy and Decentralization was established and operated as a central propulsion body, making practical results. However, as the Autonomous Decentralization Committee is regulated to last only for a temporary period of 5 years, it leaves worries about whether decentralization and transfer of central authority and office work can be properly implemented. Measures and efforts are needed to ensure that the Autonomous Decentralization Committee performs its function well even for a temporary period of existence. In particular, a long-term and continuous review of research on transfer of authority and office work is required, including the establishment and operation of support organizations such as the Local Transfer Cost Assessment Committee. In this article, it will be focused on supporting organizations for local transfer including the Local Transfer Cost Assessment Committee. Referring to the case in France, it would be said that the need for support organizations such as the Local Transfer Cost Assessment Committee is recognized. However, in the case of Korea, there is a limitation in maintaining such an organization as a specialized committee of the Autonomous Decentralization Committee under the President, as it is now, because of the temporary nature of the Autonomous Decentralization Committee, so a new plan for its status and continued survival must be prepared. The local relocation cost evaluation committee is composed of 12 experts on local finance and local relocation cost evaluation. The composition of the Local Transfer Cost Assessment Committee pursuant to Article 21-2 (3) of the Enforcement Decree of the Local Decentralization Act is composed of an equal number of central and local governments as well as a representative of the local government as its chairman. It can be seen that it contrasts with the case of (CCEC). On the other hand, since there is a need for continued existence of the Local Transfer Cost Assessment Committee, it is necessary to directly specify the basis for the local decentralization law. Until the temporary period of the Autonomous Decentralization Committee expires, it seems that the revised law should be prepared through an agreement within the National Assembly. In addition, this article describes the principles to be considered by the local transfer cost evaluation committee.
