학교폭력예방법 개정과 행정심판 청구의 문제점

국문 초록

2012년 2월 정부는 “학교폭력근절 종합대책”을 발표하면서 가해학생 조치의 학교생활기록부 기재 등 가해행위에 대한 보다 강력한 대응 수단 마련으로 학교폭력 근절의 의지를 드러냈다. 이후 관련한 입법 중 가해학생 조치의 학교생활기록부 기재로 인하여 조치에 불복하는 행정쟁송이 폭발적으로 증가하였고 학교 현장의 분쟁과 갈등은 심화되었다. 정부의 기대와 달리 학교폭력예방법의 허점과 불만이 드러나면서 여러 차례 법 개정이 이루어졌지만 여전히 미진한 것으로 평가되었고, 2019년 8월 20일 그동안 가･피해학생의 조치를 심의하였던 학교폭력대책자치위원회를 폐지하는 대대적인 개정을 다시 한번 단행하였다. 현행 학교폭력예방법(법률 제16441호, 2019. 8. 20. 일부개정)의 핵심적인 개정은 심의기구의 상향이관, 학교장 자체해결제의 도입, 불복방법의 일원화로 요약할 수 있다. 현 시점에서 위와 같은 개정 조항이 학교폭력 근절에 기여하였는지 평가하는 것은 시기상조이다. 다만, 불복방법의 일원화로 인한 문제점은 시행 초기부터 드러나고 있기에 본고에서는 현행 학교폭력예방법의 주요 개정 내용을 살피고 나아가 가･피해학생의 불복이 행정심판 청구로 일원화되면서 법리적으로나 정책적으로 재검토되어야 하는 사항들(보호자의 청구인 적격, 피해학생 청구의 근본적 문제, 집행정지 결정과 학교생활기록부 기재의 실무)에 대하여 상세히 논하고 이에 대한 해결책을 제시하였다. 보호자가 청구인 적격을 가지는 것처럼 특별히 규정한 것은 입법의 미비로 보여 삭제하여야 한다. 타인의 불이익한 조치를 더 가중하게 요청하는 의미의 행정심판 청구는 행정심판 이론에 부합하지 않아 피해학생 청구는 재고되어야 한다. 또한 집행정지결정으로 인한 학교생활기록부 기재 여부는 교육부 차원에서 정확한 법적 이해를 토대로 업무를 추진하여야 한다는 결론에 이르렀다.

영문 초록

In Feb. 2012, the Korean government published “A General Solution to Eradication of the School Violence”, while revealing a strong will to root out the school violence by arranging some strong counter-measures against it; one of them would be a recording of the fact of the school violence on perpetrator students’ school report. Thus, the administrative trials have increased explosively, appealing for erasure of such records, while the educational scenes or schools have suffered from such increasing disputes and conflicts. Hence, School Violence Prevention Act has been amended several times, as the loopholes and dissatisfaction have been revealed, but the amended Act is evaluated still as unsatisfactory. On August 20, 2019, the Autonomous School Violence Counter-Measure Committee system that had deliberated on the counter-measures against the school violence was repealed, while the Act was amended extensively. The core amendments of the current School Violence Prevention Act (No. 16441, amended partially on Aug. 20, 2019) are upward transfer of the deliberation committee, introduction of the autonomous solution by the principal, and streamlining of the appeals. It may be too early to assess whether the amended Act has conduced to eradication of the school violence. Merely, since the streamlining of the appeals has caused some problems, this study reviews the major amendments of School Violence Act and thereupon, discusses various legal and policy problems caused by such streamlined appeal system or the administrative appeal applications; the problems involve guardian’s eligibility for standing to appeal, fundamental problem regarding victim students’ appeal, decision on suspension of the punishment, recording of the violation on perpetrator’s school report, etc. Then, this study suggested their solutions. The reform measures suggested by this study are as follows. The provision about guardian’s eligibility for the appeal should be abolished. The administrative appeal for heavier punishment must not match the administrative appeal system theories. Namely, the victim students’ eligibility for the administrative appeal should be re-examined. Besides, the recording of the suspension of the punishment on perpetrator student’s school report needs to be re-examined strictly in terms of its supporting legal theories.
