국문 초록

본 논문은 “21대 국회 초반기 사학법 개정 법률안의 쟁점과 사학입법정책”을 중심 주제로 하여 크게 사학법 개정 추진 상황 분석, 개정안의 쟁점 검토, 사학입법정책의 바람직한 방향 등 세 가지 내용을 다룬 것이다. 이를 위하여 본 연구는 주로 문헌연구로써 국회 의안정보 사이트에서 21대 국회 사학법 개정안들의 내용을 확인·검토하고, 선행 문헌들을 참고로 하여 이것들의 추진이 합당한가 하는 점을 살펴보는 작업을 수행하였다. 사학법 개정 법률안의 내용에 대한 이러한 검토 결과, 확인할 수 있었던 공통적인 문제점은 이 개정안들이 모두 사학에 대한 규제 일변도의 특징을 보이고 있는 점이다. 개정안들의 규제 관련 내용들로는 학교법인의 임원 구성 및 회의 운영에 대한 규제, 사학 재정 운용의 통제, 교직원 임용권의 제한, 학교법인의 징계권 견제 등이다. 끝으로 본 논문에서는 이러한 문제점을 극복하기 위한 사학입법정책으로 세 가지 사항을 제안하였다. 첫째, 사학평가제도의 도입과 함께 우수사학･부실 사학에 대한 이원화 정책을 도입할 것, 둘째, 사학에 대한 재정 지원과 사학 규제를 연계하여 접근하기보다는 별개의 문제로 접근할 것, 셋째, 사학의 공영화보다 공학의 민영화 정책을 고려할 것 등이다.

영문 초록

Six months have passed since the 21st National Assembly opened on May 30, 2020. In the meantime, many private school law revisions have been proposed. As of December 4, 2020, 35 articles, 47% of the total 74 provisions of the Private School Act, were subject to revision. It is almost a full-scale revision in content. In terms of the form of the law, the revision to the Korean language of the entire article of the Private School Act has already been passed. It is also being born entirely new in form. It is worth noting the contents of the revised Private School Law. Lawmakers want strong regulations to ensure the transparency of private schools and hold private school contestants accountable. The justification for regulation is that private schools receive a lot of support from the state. I think that if the amendments are passed, the contraction of the private school becomes apparent. I am worried that the contents and methods of education will be standardized, thereby reducing the guarantee of freedom of thought, conscience, and religion of the people, which are the soil for fostering citizens of democratic countries, and the formation of various spiritual cultures. Even now, we must strive for the recovery and existence of private schools. This paper aims to cover three main contents according to the purpose of these studies.First, analyze the overall legislative trends of the amendments to the Private School Law. Second, the issues of the amendment are reviewed by area of content. Third, to sum up the overall problems of the bills. Fourth, it refers to the points that should be pursued in the private school policy.
