인공지능, 3D 프린팅 기술이 촉발하는 특허법 및 저작권법의 쟁점과 과제

국문 초록

세계경제의 저성장 기조인 저금리･高실업률･정부 부채 증가 등 ‘뉴 노멀(New Normal)’ 시대를 타개하기 위한 新성장동력으로 기대되는 인공지능과 3D 프린팅 기술은 각국의 진흥 정책에 힘입어 과거의 혁신보다 빠른 속도로 확산되고 발전하고 있다. 인공지능과 3D 프린팅 기술이 각광 받는 이유는 이 기술을 통해 생성된 데이터는 “디지털 영역”에 있지만 그 데이터가 제어, 수정, 개량, 발전하는 등의 파급력은 “물리적 영역”인 다양한 산업에서 새로운 가치를 창출하는데 유용하게 사용된다는 것이다. 그러나 신기술의 도입으로 변화하게 된 물리적 세계에서 디지털 정보･콘텐츠 중심의 패러다임에 기민하게 대응하지 못한 지적재산권법 때문에 인공지능과 3D 프린팅으로 인해 특허법과 저작권법에서 법리적 간극과 혼란이 발생했다. 그 이유는 과거 기술 수준에 터 잡은 “물리적 영역에서 인간” 중심의 패러다임에서 제정된 기존 법리로는 물리적 세계와 디지털 세계의 경계가 없어진 변화된 환경에서 이루어진 발명, 창작 행위를 규율하는데 한계가 존재했기 때문이다. 이러한 문제의식에서 출발하여 이제 지적재산권법은 기존의 패러다임에 혁신적인 변화를 가져오는 인공지능, 3D 프린팅 기술을 기화로 그동안 지나치게 사후적 견지에서 일변도로 이루어진 입법 방식에서 향후 시장의 변화와 대중의 행동 양식에 어떤 영향을 초래할지를 사전적 견지에서 고려하는 태도로 변혁해야할 필요에 따라 어떠한 사항을 중점적으로 고려해야할지 탐구할 필요가 있다. 특히, 지적재산권법의 파급력은 기술 그 자체의 흥망성쇠(興亡盛衰)와 함께 관련 산업과 국가의 경쟁력 및 경제 성장과 직결되는 사안이기에 사전적 관점에서의 입법이 보다 중요하다 할 것이다. 인공지능, 3D 프린팅 기술이 야기한 분쟁과 문제에서 타당한 결과를 실현하는 것을 기본으로 하되, 입법의 방향성이 대중과 사회 전반에 미치는 영향도 중요하게 고려함으로써 기술 혁신, 산업 발전 등 공익을 저해하는 우매한 결론을 피해야 한다. 파괴적 혁신을 몰고 온 신기술의 등장으로 그동안 최종판단자의 시각에서 사건 발생 후 사후적으로 판단하는 것에 경도된 법학의 전통적인 태도와 역할에서 지적재산권법 그 자체의 법적 개념, 범위, 판단 기준의 패러다임 전환뿐만 아니라 법학의 관점과 시각도 혁신과 쇄신을 필요로 하고 있다.

영문 초록

Artificial intelligence and 3D printing technologies, which are expected to be new growth engines to break the “New Normal” era, such as low interest rates, high unemployment rates and increased government debt, are developing faster than past innovations thanks to promotion policies from each country. The reason why artificial intelligence and 3D printing technology are in the spotlight is that the data generated by the technology is in the “digital domain”, but the ripple effects of the data being controlled, modified, improved and developed are useful in creating new value in a variety of industries that are “physical domain”. However, due to the intellectual property law, which failed to respond quickly to the digital information-oriented paradigm in the physical world, which was transformed by the introduction of new technologies, artificial intelligence and 3D printing caused legal gaps and confusion in patent and copyright laws. The reason for this is that the existing legal principles established in the paradigm centered on “human in the physical domain” based on the level of the past technology had limitations in regulating the inventions and creative acts made in a changed environment where the boundaries between the physical and digital worlds blurred. Starting with this awareness, the Intellectual Property Law now needs to explore what needs to be focused on changing from an overly ex post legislative approach to an ex ante approach of how it will affect future market changes and public behavior, using artificial intelligence and 3D printing technologies that bring about innovative changes in the existing paradigm. In particular, legislation from an ex ante perspective will be more important because the impact of the intellectual property law is directly related to the competitiveness and economic growth of related industries. With the advent of new technologies that have led to disruptive innovation, not only the paradigm shift of the intellectual property rights law itself in the traditional attitude and role of jurisprudence, but also the views and perspectives of jurisprudence need to be reformed.
