국문 초록

2019년말 기준 한국공인중개사협회 자료에 의하면 등록관청에 신고된 중개보조원은 67,064명이다. 신고 되지 않은 중개보조원도 상당수일 것으로 추정된다. ｢공인중개사법｣상 중개보조원은 중개대상물에 대한 현장안내와 일반서무 등 단순한 업무만 수행하도록 규정하고 있지만 현실에서는 중개보조원이 중개대상물의 광고, 거래계약체결 등 불법 중개행위가 이루어지고 있다. 이로 인한 중개보조원의 법적 책임규정과 피해가 발생한 거래당사자의 손해배상 등에 대한 제도적 장치가 미진한 상황이다. 본 연구는 2018~2019년 부동산거래사고 판례 중에서 중개보조원에 의한 사고 사례를 선별하고, 유형별로 분류하였다. 그리고 중개보조원에 관한 부동산거래사고를 중심으로 판례를 분석하여 문제점을 도출하고, 이에 대한 제도방안을 제시하고자 하였다. 연구결과 첫째, 중개보조원 수를 제한하고 명칭을 개정하여야 한다. 둘째, 무등록 및 불법 중개행위자 단속과 처벌규정 강화하여야 한다. 셋째, 개업공인중개사에 고용된 중개보조원 등에게 손해배상책임을 부여하여야 한다. 마지막으로 권원보험제도와 에스크로우제도를 활성화하여 중개보조원에 의한 거래사고를 사전에 예방하는 것이 중요하다.

영문 초록

According to Korea Association of Realtors(KAR), there are 67,064 brokerage assistants reported to the registration office as of the end of 2019. It is estimated that there are also a large number of unreported assistants as well. Under the law, brokerage assistants are only required to perform simple tasks such as on-site guidance and general affairs. However, in reality, they are engaged in illegal brokerage activities such as advertisement of brokerage objects and signing transaction contracts. Despite this situation, there is insufficient institutional system in which brokerage assistants are liable or compensated for the damages. For this study, among the cases of real estate transaction incidents from 2018 to 2019, those caused by brokerage assistants were selected and classified by type. In addition, I derived problems by analyzing cases to present institutional plans. The conclusions derived from the study are as follows. First, the number of brokerage assistants should be limited and their name be revised. Second, regulations on crackdown and punishment for unregistered and illegal brokerage activities should be strengthened. Third, liability for the damages should be given to brokerage assistants hired by licensed real estate agents. Lastly, it is important to vitalize the title insurance system and escrow system to prevent transaction incidents inflicted by brokerage assistants in advance.
