국문 초록

4차산업혁명에 의한 ICT의 기술발달과 지능정보화사회가 진전되면서 우리나라를 비롯한 미국, 이탈리아, 일본 등의 국가에 공유경제가 확산이 되고 있다. 우리나라는 공유경제기본법이나 공유경제를 촉진할 수 있는 법제가 마련이 되어 있지 아니하여 공유경제를 확산하는데 한계가 있다. 또한 규제샌드박스에 의하여 공유경제에 실증사업을 하는 경우에도 많은 규제에 의하여 공유경제의 활성화하는데 장애가 되고 있다. 그럼에도 불구하고 서울특별시와, 경기도, 광주광역시 등의 광역지방자치단체에서는 공유경제촉진조례를 제정하여 공유경제를 구현하고자 노력하고 있고, 국회에서도 공유경제기본법안을 발의하여 입법 추진 중에 있다. 공유경제는 그 개념이 정립되지 아니하여 불확정적이어서 법적분쟁이나 갈등이 야기될 것이므로 이를 해결하기 위하여 법적 개념을 명확히 확립하여야 한다. 공유경제는 ICT기반의 플랫폼에서 더욱 촉진시킨다. 따라서 공유경제의 개념을 정보통신기술기반의 플랫폼을 통하여 유휴자산(기술, 시간 등 포함)과 서비스 사용을 공유함으로써 지역경제를 활성화하는 협업경제라고 정의할 필요가 있다. 또한 숙박공유경제를 활성화하는 경우에도 소비자보호와 안전사고를 미연에 방지하기 위한 법제도적 장치도 마련되어 져야 한다. 따라서 공유경제의 개념과 공유경제의 활성화의 필요성을 검토한 다음, 우리나라의 공유경제에 관한 법체계를 고찰함으로써 미국, 일본 등의 공유경제에 관한 입법례를 비교법적으로 검토하여 공유경제기기본법 제정, 숙박공유경제법 마련, 공유경제의 합리적 규제, 공유경제에 관한 조세부과방안 등을 검토하여 공유경제법체계를 정립함으로써 플랫폼 경제의 구현을 비롯한 도시의 경제적·사회적·환경적 문제의 해결에 이바지하고자 한다.

영문 초록

The sharing economy is spreading to countries such as the United States, Italy, and Japan, including Korea, as the technology development of ICT and the intelligent information society progressed by the Fourth Industrial Revolution. In Korea, there is a limit to the spread of the sharing economy as there is no basic law on the sharing economy or a legal system to promote the sharing economy. In addition, even when conducting a demonstration project in the sharing economy through a regulatory sandbox, it is an obstacle to revitalizing the sharing economy due to many regulations. Nevertheless, metropolitan local governments such as Seoul, Gyeonggi-do, and Gwangju are making efforts to realize the sharing economy by enacting ordinances for promoting the sharing economy, and the National Assembly has also proposed and is pursuing legislation. Since the concept of the sharing economy is not established and it is uncertain, legal disputes or conflicts will arise, so a legal concept must be clearly established to resolve this. The sharing economy is further promoted on an ICT-based platform. Therefore, it is necessary to define the concept of the sharing economy as a collaborative economy that activates the local economy by sharing idle assets (including technology, time, etc.) and service use through an information and communication technology-based platform. In addition, even in the case of activating the accommodation sharing economy, legal and institutional measures should be prepared to protect consumers and prevent safety accidents in advance. Therefore, after reviewing the concept of the sharing economy and the necessity of revitalizing the sharing economy, by reviewing the legal system related to the sharing economy in Korea, comparatively reviewing legislation related to the sharing economy in the United States and Japan, enactment of the Framework Act on Sharing Economy By reviewing the provision of the sharing economy law, rational regulation of the sharing economy, and tax imposition plans on the sharing economy, the sharing economy law system was established, thereby contributing to the realization of the platform economy, regional economic development, and the resolution of urban and environmental problems in cities.
