국방의 의무의 헌법적 의미와 정당화 조건

국문 초록

근대 헌법국가의 탄생과정에서 국방의 의무는 절대군주의 자의적인 징병으로부터 신체를 보호하기 위해 ‘법’으로써 의무를 형성하여 시민적 권리를 보호한다는 의미를 가진다. 그리고 주권자로서의 국민이 스스로 병력을 형성하여 국가를 방위함으로써 자신들의 ‘자유’를 지켜내고, 구체제의 의무 부담의 불평등으로부터 국민이 모두 동등하게 전쟁에 참여한다는 ‘평등’의식을 보여주었다. 그러나 전쟁이 계속되면서 국방의 의무의 의미는 변질되기 시작하였다. 대한민국에서 징병제는 전시라는 예외적 상황에서 급박하게 도입되었고, 분단체제 하에서 독재정권의 지배를 강화하는 수단이었다. 시민적 권리와 결부되지 않은 채 강제적으로 도입된 징병제에 의해 국민은 자신들의 권리를 지키기 위해 공동체를 방위하는 ‘주체’가 아니라 국가동원의 ‘도구’로서 존재하였다. 민주화 이후 군대는 ‘헌법’에 복종함으로써 정치적 중립성을 유지하고, ‘민주적’으로 운영･관리될 수 있도록 재정비 되면서 국민군으로서의 지위를 회복하였다. 하지만 과거의 경험으로 인해 국방의 의무에 대한 이해는 왜곡되어 있다. 국방의 의무의 의미에 대한 정확한 이해는 국방의 의무를 공화주의적으로 재해석하는 것, 즉 국방의 의무의 출발시점으로 되돌아가 그 의미를 복원함으로써 가능해질 수 있을 것이다. 공화주의적 이해에 따르면, 국방의 의무는 공동체 구성원들의 참여 및 협력을 유도하기 위하여 첫째, 공화주의적 애국심을 복원하고, 둘째, 공동체 구성원 모두가 평등하게 의무를 부담하고, 셋째, 시민군 체제를 강화하는 것이 중요하다. 이러한 정당성의 조건들이 충족되는 한 국방의 의무의 의미가 퇴색될 수는 없을 것이다.

영문 초록

The duty of national defense means protecting the rights of citizens by forming an duty as a ‘law’ in order to protect the people s body from arbitrary conscription of monarchies in the process of the birth of modern constitutional states. And it showed that the nation as sovereigns protect their ‘liberty’ by defending the state from external threats, and the ‘equality’ consciousness that all citizens who compose the community are equally involved in the war. However, as the war continued, the meaning of the duty of national defense began to change. In the Republic of Korea, conscription was urgently introduced under the exceptional situation of the Korean War, and it was a means to strengthen the rule of dictatorship under the division system. The conscription system, which was introduced compulsorily without association with civil rights, has made the nation as ‘tools’ of state mobilization, not as ‘subjects’. After democratization, the army regained its status as a national army by obeying the ‘Constitutional law’ and being managed into ‘democratic’. But past experience has perverted the perception surrounding the duty of national defense. Distorted understanding of the duty of national defence could weaken the legitimacy of the duty of national defence. Therefore, it is necessary to reinterpret the duty of national defence in a republican way. In order to realize the ideal of the republican universal conscription system, and to induce voluntary participation and cooperation of citizens on the duty of national defence, it is important to restore the republican patriotism, to burden equal to all citizens, and to strengthen the citizen soldier system. As long as these conditions of legitimacy are met, the meaning of the duty of national defence will not be tarnished.
