컨소시엄 블록체인 기술의 활용시 공정거래법 저촉 여부에 대한 고찰

국문 초록

컨소시엄형 블록체인은 그들이 저장한 거래의 기록을 노출시키지 않는 기밀성이 보장되는 점, 네트워크 참여자가 소수로 구성되어 있어서 거래를 신속하게 처리할 수 있는 점, 블록체인의 활용에 따라 비용이 절감된다는 점, 개인 P2P 네트워크를 실시간 모니터링할 수 있다는 점 등 기업의 요구(Needs)를 충분히 보장하고 있어서 비즈니스에 매우 적합한 형태라고 할 수 있다. 따라서 기업들은 이 형태의 블록체인을 이미 도입하였거나 적극적으로 도입을 검토하고 있다. 해외에서도 이의 활용에 적극적인 관심을 보이고 있다. 다만, 이와 관련하여 다른 한편으로는 공정거래법에 저촉하는 것이 아닌지에 대해서도 함께 검토가 진행되고 있다. 즉, ①컨소시엄 블록체인의 기존 네트워크 참여자 간의 정보교환에 의한 공모, 즉 담합을 하는 경우가 없는지, ② 기존 네트워크 참여자가 시장지배적 지위를 남용하여 신규 네트워크 참여자가 블록체인 기술을 효율적으로 도입하는 것을 방해 또는 지체하거나 참가 자체를 배제하는 경우에 대하여 공정거래법의 저촉이 없는지에 대하여 신중한 검토를 하고 있다. 다만, 이는 컨소시엄 블록체인을 규제하기보다는 이 제도를 적극적으로 활용하기 위한 관점에서 검토하고 있다는 점에 주목할 필요가 있다. 이에 이 글에서는 컨소시엄 블록체인 기술을 도입하여 활용할 경우 발생될 수 있는 문제점, 특히 공정거래법의 저촉 가능성에 대하여 살펴보고자 한다. 구체적으로는 제2장에서 블록체인 기술의 활용과 퍼블릭형 블록체인의 한계, 제3장에서는 퍼블릭형 블록체인에 대한 대응으로 컨소시엄 블록체인 기술의 활용과 이에 대한 우리나라의 대응, 제4장에서는 컨소시엄 블록체인 기술의 활용에 따른 공정거래법의 문제가 없는지에 대한 OECD와 일본에서의 논의, 마지막 제5장에서는 OECD와 일본법을 비교 분석하면서 우리나라 공정거래법에의 저촉 여부를 검토하고자 한다.

영문 초록

Consortium-type blockchains are suitable for business of enterprises. This is because consortium-type blockchains ① ensure confidentiality that does not expose the records of transactions they store. ② ensure the speed of the transaction as the participants are consist of a small number of participants, ③ ensure saving of costs according to the utilization of the blockchain, ④ensure the needs of enterprise for real-time monitoring of private P2P networks. Therefore, Many Enterprises have already been introduced or are under conderation for the introduction of this type of block chain. Foreign countries such as OECD and Japan, etc. showed active interest in its utilizing this type of blockchain and on the other hand, they were also reviewed whether this blockchain violates the Fair Trade Act. Concretely, Firstly, the consortium s existing participants in the block chain were reviewed to see if there were any collision through information exchange among them. Secondly, It was reviewed whether existing participants were preventing or delaying the efficient introduction of block chain technology by new participants. It also examined whether he excluded participation in the block chain itself. However, it should be considered as active utilizing rather than regulating the consortium s block chain, Thus, in this paper I will examine the problems that may arise if the consortium block chain technology is introduced and utilized, especially the possibility of the violation of the Fair Trade Act. To be specific, in Chapter2, I would like to mention the general concept of block chain technology and the limitations of public type block chain. And Next, in Chapter 3, I would like to mention the use of consortium block chain to solve public block chain problems and our country s response to it. In Chapter 4, I would like to discuss with the OECD and Japan whether there is a problem with the fair trade law due to the use of consortium block chain. And in the last chapter, I would like to examine whether the use of the consortium s block chain violated Korea s fair trade law through a comparison with OECD and Japanese laws.
