공동체적 관점으로서의 전환적 사법에 관한 연구

국문 초록

전환적 사법(Transformative Justice)란 전통적인 형사사법적 해결을 지양한다는 점에서는 회복적 사법과 일치한다. 그러나 회복적 사법이 범죄자와 피해자의 관계 및 이해관계인의 참여를 통한 치유와 화합 및 배상을 강조하는 반면, 전환적 사법은 일단 가해자와 피해자의 개념 및 그 역할을 부정하는 관점에서 출발한다. 범죄행위의 결과 발생한 피해를 중심으로 접근하지 않고, 범죄의 원인 및 사회적 구조의 결함, 범죄를 야기시키는 사회적 문제의 과잉상태 등을 중심으로 하여 근원적인 해결을 시도하고자 한다. 즉, 전환적 사법은 회복적 사법과는 달리 기본적으로 범죄를 개인의 자산으로 보지 않고, 사회변화의 긍정적 원동력으로 보고자 한다. 가장 중요한 점은, 범죄자와 범죄피해자라는 역할나누기를 금지하고 모두 공동체의 구성원으로서만 이해하면서 그로 인해 발생되는 부정의에 대응할 사회공동체의 자생력을 회복할 것으로 요구한다. 즉 전환적 사법은 사회공동체의 자생력 회복을 위하여, 교육체계, 의료체계, 환경과 복지체계, 임금과 노동구조, 경제적 평등 등 사회전반의 자산을 동원하여 부정의의 원인을 극복하고 지속가능한 평화재건만을 목적으로 한다. 개인차원의 책임과 그에 상응하는 처벌이 불필요하다고 보는 것은 아니지만, 그것이 중심이라고 결코 해석하지 않는다. 우리 사회가 직면한 바는 거대하고 비대해지는 국가형벌권에 비해 너무나 초라해지고 있는 사회공동체의 건강한 자생력의 상실이다. 그렇다면 근본적인 해결방법은 체계적으로 공동체의 윤리를 회복하고 사회공동체의 기능을 정상화함으로써 지속가능한 평화를 구축하는 한편, 처벌의 영역을 축소하고 국가형벌권의 확대를 방지하는 것이다. 국가의 강제력에 대한 의존도가 높아질수록 처벌의 영역이 확대되는 것은 불가피하다. 물론 처벌이 필요한 영역과 회복이 필요한 영역이 있고 양자가 중첩될 수 있다. 그러나 응보와 회복은 사회공동체의 자생력을 확보하기 위한 수단으로 이해되어야 하지, 그 자체가 추구해야할 목적은 아니라는 점이다. 여기에서는 이를 풀어낼 단초로서 전환적 사법이라는 개념에 대하여 시론적으로 살펴보았다. 아직까지 완전히 정립된 정의개념은 아니지만, 전환적 사법에 대하여 기존의 이론들을 보다 강화하기 위한 방편으로써의 역할을 부여할 수도 있고 그 자체로서 응보적 사법이나 회복적 사법을 포괄하는 새로운 대안으로서의 위상을 기대할 수도 있을 것이다.

영문 초록

So far, restorative justice has been understood as a concept of justice replacing national punishment and retributive justice which means the responsibility and cost of criminal offenses. But restorative justice is unable to replace entirely criminal justice system as well as to build or drive its process and method uniformly or to be accepted as compulsory effect. And more over, more various justice definition concepts have appeared recently, for example, transitional justice, creative justice, compensatory justice, transformative justice and so forth. Each concept has tried to function as justice which replace or make up for the deficiency of criminal system. Especially transformative justice has been focused as unified and driven justice that enable multi-disciplinary and multi-sectoral approaches and considers rights indivisible and interdependent, gives equal consideration to social and economic rights. the terms of transformative justice are very various including to systematic, substantive, socioeconomic, psychosocial, integrated, historical and sustainable aspects of justice. Before transformative justice, transitional justice has become a globally dominant lens through which to approach states addressing legacies of a national violent past after World War Ⅱ. But transitional justice was understood as change driven by state-centric institutional mechanisms and needs for international law, rights and norms. Now transitional justice have to go for transformative justice because transformative justice is understood as transformative change that emphasises local agency and resources, the prioritization of process rather than pre-conceived outcomes. From a community perspective, transformative justice can establish conditions and structures to ensure sustainable justice in the future as well as to reinforce peace-building in society through solidarity. Of course, transformative justice is not constructed as intimate idea. But it suggests that our society can build impregnably apart from national criminal power and free from incarceration.
