국문 초록

주택임차인 보호를 위한 제도 가운데 가장 핵심적인 내용은 임대차기간 보장과 임대차계약 종료 시 전세보증금 반환으로 ｢주택임대차보호법｣은 임대차기간을 최소한 2년으로 보장하고 강제하고 있으며, 임대인이 임차인에게 전세보증금을 제때 반환하지 못하는 경우를 대비하여 대항력과 우선변제권을 인정하고 있다. 또한 임차인은 보증기관이 제공하는 전세보증금 반환보증에 임의로 가입하여 신속하고 간편한 방법으로 전세보증금을 돌려받을 수도 있다. 그러나 최근 다주택 임대사업자가 임차인에게 전세보증금을 돌려줄 수 없는 상황이 빈번하게 발생하면서 다수의 임차인 피해가 증가하고 있고 사회문제가 되고 있어 근본적인 해결방안이 요구되고 있다. 이에 따라 본 연구는 주택임차인이 전세보증금을 제때 돌려받지 못하는 상황에 대비하여 마련된 전세보증금 보호제도와 임대차현황을 살펴보고, 문제점을 검토하여 개선방안을 제시하고 근본적인 해결방안으로 일정한 규모 이상 다주택 임대사업자의 신용보강 확대를 제안하고자 한다.

영문 초록

The most important things of the system for the protection of the tenant is to guarantee the rent period and to return the rent deposit at the end of the rent contract. In case of failure, we have admitted the opposing power and the right to reimburse. The tenant can also arbitrarily sign up for a rent deposit guarantee provided by the guarantee corporation which returns the rent deposit in a quick and convenient way. However, in recent years, as multi-homeowners’ or rental companies are frequently unable to return rent deposits to tenants, the number of tenant damages is increasing and it is becoming a social problem, which requires a fundamental solution. Accordingly, this study examines the status of the rent deposit protection system and the situation which the tenant does not receive the rent deposit in time. And I would like to suggest to propose some improvements and to expand the credit enhancement of multi-homeowners’ rent business as the fundamental solution over a certain scale by reviewing implications and problems.
