軍형사법상 회복적 사법 도입 여부에 관한 고찰

국문 초록

형사사법은 발생된 범죄를 처리하는 일련의 사법작용이다. 군형사법 또한 평시 전투력 보존과 전시 전쟁의 승리를 위해 존재하는 군대에서 발생하는 범죄를 처리하는 사법작용으로 볼 수 있다. 이러한 군 조직을 기반으로 한 군형사법은 범죄의 진압과 감소를 최우선적 과제로 추구하는 범죄통제 모델을 바탕으로 강하고 엄정한 법률들로 구성되어 있다. 이러한 특성을 가지고 있는 군형사법의 적용 대상들은 헌법상 국방의 의무를 다하고 있는 젊은 청년들이다. 이들은 20대 중요한 시기를 국가의 방위를 위해 희생하면서 헌신하고 있다. 국토방위를 위해 신성한 의무를 지고 있는 대한민국 젊은이들에게 엄정한 규율을 기반으로 하고 있는 군형사법은 자칫 사소한 실수를 저질러도 그들의 희생이 물거품이 될 수밖에 없는 현실을 간과하고 있는 듯하다. 의무복무라는 현실 속에서 국가는 이들에게 불이익이 되는 처우를 최소화할 필요가 있다고 본다. 이러한 고민 속에 등장한 것이 바로 회복적 사법이다. 회복적 사법은 범죄자에 대한 응보적 처벌이라는 단순한 사고에서 벗어나 범죄자의 피해뿐만 아니라 범죄피해자의 피해, 더 나아가 사회공동체의 피해와 그 피해의 회복에 목적을 둔다. 이는 엄정한 군형사법에서 볼 수 없는 사법체계이기 때문에 의무복무자가 대부분인 군대 사회에 적용될 수 있다면 군형사법의 효율성과 군인의 인권개선에 큰 기여를 할 것이다. 회복적 사법의 프로그램인 조정모델, 협의모델, 써클모델을 기반으로 현재 우리나라 사법기관에서 시행중인 회복적 사법의 요소가 포함된 제도들을 군형사법체계와 조율될 수 있는 제도들을 검토하고자 한다. 예를 들어 군수사개시전 상담, 군수사개시후 화해중재, 군범죄가족협의회, 군경미범죄 심사위원회, 군검찰관결정전 양형회의이다. 이들은 현재 우리나라 군형사법 체계에서는 볼 수 없는 회복적 사법의 이념이 스며든 제도들로 도입여부에 대한 연구활동은 앞으로도 지속될 필요가 있다. 이러한 제도들의 도입되기 위한 시도는 더 나은 군형사사법의 발전의 계기가 되기를 기대해본다.

영문 초록

Criminal justice is a series of judicial actions that deal with crimes that have occurred. Military criminal justice can also be seen as a judicial process for dealing with crimes in the military that exist to preserve peacetime and win wartime wars. The military criminal law based on such a military organization is composed of strong and strict laws based on a crime control model that seeks to suppress and reduce crime as a top priority. The subjects of military criminal law with these characteristics are young people who are fulfilling their constitutional defense duties. They are dedicated at the expense of their twenty important times for national defense. The military criminal law, which is based on strict rules for young Koreans who are sacred to defend their homeland, seems to overlook the reality that their sacrifice can be a bubble even if a minor mistake is made. In the reality of compulsory service, the state needs to minimize the disadvantageous treatment for them. It is the restorative justice that emerged in this agony. Restorative justice aims at breaking away from the simple thought of retributive punishment to offenders, as well as the damages of criminal offenders, as well as the damage of the social community and the restoration of the damages. This is a judicial system that is not found in the strict military criminal law, so if it can be applied to the military society where the duty workers are mostly, it will greatly contribute to the efficiency of military criminal law and the improvement of the human rights of soldiers. In this paper, based on the reconciliation model, consultation model, and circle model, which is a program of restorative justice, this paper examines the systems that can be reconciled with the military criminal justice system. For example, consultation before military investigation, reconciliation mediation after investigation of the military, military crime family council, military minor crimes jury council, military prosecutor decision sentence meeting. If they can be realized through the examination of whether they are introduced into the system of the restorative justice, which is not seen in the current military criminal justice system, the Korean military criminal justice system can make a big change.
