국문 초록

현대 사회는 정보화 시대라고 불리워질 만큼 정보의 중요성이 증대되고 있다. 특히 개인정보는 과거와는 달리 발전된 시스템을 통해 방대한 양을 축적해 놓을 수 있는 편리함을 갖게 되었지만, 또 다른 한편으로는 이러한 개인정보의 유출에 대한 불안함 속에서 살아야 하는 운명을 갖게 되기도 하였다. 이러한 개인정보를 위해서 다양한 입법이 마련되고 있지만, 입법으로서 모든 문제를 해결하기에는 부족한 부분이 있다고 보인다. 이러한 가운데 미국의 애플사에서 사용자 동의 없이 시용자 위치정보 수집 한 사건이 발생하였다. 이에 국내의 2만 8천여 명의 애플 사용자들은 피고 애플 등의 손해배상책임을 묻는 소를 제기하기에 이른 것이다. 이에 대하여 대법원은 피고들이 원고들의 동의 없이 사용자의 개인위치정보를 수집하였음을 인정하였으나, 손해배상과 관련하여서는 인정된다고 보기 어렵다고 판단하였다. 개인정보가 개인의 전부를 나타낼 정도의 중요한 자료로서 사용되어지고 있는 사회 현실을 살펴보건대, 개인정보 유출 및 동의 없는 사용에 대해서 개인을 보호할 방안에 대한 연구가 계속 진행되어야 할 것이다.

영문 초록

The importance of information is increasing in modern society as it is called the information age. In particular, unlike the past, personal information has become useful in storing a huge amount of information through developed systems, but on the other hand, in the midst of such concerns about the leakage of personal information, personal information is destined to live. Various laws have been established for this kind of personal information, but it is thought that legislation is insufficient to solve all problems. Under these circumstances, Apple Inc. in the U.S. has collected user location information without the user s consent. As a result, more than 28,000 Apple users in Japan have filed lawsuits against defendants and Apple for damages. In response, the Supreme Court admitted that the defendants collected personal location information of the users without the consent of the plaintiffs, but found it difficult to believe that they would be recognized for damages. Considering the current state of society in which personal information is used as a material that shows all individuals, efforts to protect individuals against the leakage and use of personal information without consent should continue.
