개정 공직선거법의 문제점과 개선방안

국문 초록

최근 공직선거법이 개정되었다. 개정내용의 골자는 연동형 비례대표제의 도입과 선거연령의 인하 및 국회의원선거후보자의 당내 추천과정의 민주성 강화라고 하겠다. 과거보다 개선된 내용이다. 주지하는 바와 같이 선거제도는 한 국가의 통치기구의 조직원리이자 민주주의원리를 실현하기 위한 제도적 장치이다. 선거를 통해 대의기관이 구성되고, 국민의 의사가 국정에 반영되며, 국가작용에 대한 감시와 비판과 통제가 이루어지는 것이다. 그러기 위해서는 국민의 의사가 거울처럼 반영되는 선거제도가 마련되어야 하고, 이는 바로 보통·평등·직접·비밀·자유선거의 원칙이 최대한 구현되는 선거제도가 마련되어야 한다는 것을 의미한다. 그러나 최근의 개정내용은 여전히 문제점을 가지고 있다. 먼저 지역구의석 대비 비례대표의석수의 비율이 너무 적다. 이러한 의석비율로는 비례대표제의 취지를 살리기 어렵다. 아울러 총 의원정수가 적다. 이 의석수로는 제대로 기능하는 국회가 되기 어렵다. 또한 국회의원의 특권만 강화하는 결과를 초래한다. 외국의 인구대비 의원수와 비교해도 우리 국회의 의원정수는 너무 적다. 의원수의 증원이 요구된다. 그리고 무엇보다도 문제가 되는 것은 지역구의석과 비례대표의석의 결합방식이다. 현행의 50%만 반영되는 준연동형에서 순수 연동형으로의 개선이 요구된다. 그밖에 선거구획정 시 인구편차의 2:1 미만으로의 법정화, 후보자추천과정의 민주성 강화와 그 절차와 기준의 법정화, 봉쇄조항에 있어서 저지선의 완화 등 다양한 부수적인 개선도 요구된다. 이러한 개선이 이루어질 때 우리의 선거제도가 그 본래의 이념인 다원적 민주주의의 실현에 이바지할 수 있을 것이다.

영문 초록

The Public Official Election Act is recently revised. The essential points of the contents of the revised Act can be summarized as follows; the adoption of the mixed-member propotional system, the reduction of voting age, enhancement of democratic procedures in the process of recommendation of candidates by political parties, etc. It can be evaluated that they are improved than the old Act. The election system is the important tool for the realization of the democracy and a constituting principle of representative body. Therefore, the election system should reflect exactly the will of the people. So, the system must comply with the principle of equal Ballot. The mixed-member propotional system can meet the needs. The revises Act, however, did not introduce the mixed-member propotional system, but the so called quasi mixed-member propotional system. Only 50% of the seats of the proportional representative National Assembly members according to proportion of the votes obtained by the relevant seat-allocated party in the election for the proportional representative National Assembly members is allocated to each political party. Such a system cannot optimally reflect the approval rate of the voters. It cannot consequently perform the functions of the system of proportional representation. It must be amended into the pure system mixed-member propotional. On the other hand, the number of the National Assembly members should be increased to vitalize the diverse functions of the National Assembly. Futhermore, the rate of the proportional representative National Assembly members must be expanded. Besides, the proportional representative National Assembly members shall be elected in the whole country as a unit to reduce or eliminate the overhang seats.
