대학입시 공정성 확보를 위한 법적 고찰

국문 초록

본고는 고등교육법 제31조에 따라 대학이 학생선발을 함에 따른 학생부종합전형을 중심으로 수시전형의 법적 문제를 검토한 후 정시모집과의 관계 속에서 그 개선방안을 제시하는 것이 목적이다. 三不政策의 내용인 고교등급이 학생부종합전형에서 재량의 남용으로 악용될 소지가 있다. 논술전형에서도 고교교과과정 범위를 넘어섬으로서 본고사역할을 하는 면이 있어 기여입학제만 순수히 금지된 형편이다. 그래서 대학입시의 가치체계에 있던 삼불정책의 현실적 해체를 주의하여야 함을 언급하였다. 정시와 수시의 비율을 50:50으로 조정하는 방안, 학생부종합전형에서 비교과 활동 중 창의성과 다양성 함양과 거리가 있는 교육의 비본질적 요소를 축소하는 방안, 학생선발에 의문이 있는 경우 결정자료에 접근할 수 있는 정보접근권과 대학의 학생 선발 과정상 발생할 수 있는 과실 등을 교육수요자가 확인할 수 있도록 무하자재량행사청구권의 활성화를 제안하였다(IV).

영문 초록

The aim of this study is to present improvement measures in the relationship with regular admissions after reviewing the legal issues of frequent admission based on the comprehensive student selection by universities according to Article 31 of the Higher Education Act. The “Three Forbidden Policy”, which had been blocked by the college entrance exam(Contribution admission system, the high school grading system, and the university s main exam), has been graded in fact by high school students in relation to the general admission process. The essay format of a university actually serves as the main test. Therefore, only the actual contribution system remains pure. Therefore, the main text mentioned the need to pay attention to the realistic dismantling of the ‘Sambul policy’. Furthermore, the Commission proposed that the ratio of on-time and off-time should be adjusted to a ratio of 50:50. And that comparison and activities in the comprehensive student system should be reduced except that they are truly creative and conformed to the nature of education. The access to information that can access decision data in case of doubt, and the selection of students and the negligence that can arise in selecting them should all be enhanced as a summary measure of the university admission process.
