헌법 제31조 제4항에 기반한 지방교육자치제 개선방안

국문 초록

『헌법』 제31조 제4항은 ‘교육의 자주성･전문성･정치적 중립성’을 보장한다. 교육은 당파적 편향성에 의해 부당하게 침해 및 간섭당하지 않아야 하고(89헌마88), 교육제도 법률주의는 일시적인 특정 정치 세력에 영향을 받지 않고 교육체계를 일관성 있게 유지, 발전시키기 위한 것이다(99헌바14). 전국동시지방선거에서 정당정치를 대별하는 보수와 진보의 이념 대결의 맥락에 포괄된 교육감선거에서 후보자는 공공연하게 정치적 이념을 내세우고, 언론은 당락에 영향을 미치는 정치적 이념의 프레이밍 방식으로 보도한다. 교육감후보의 정치적 이념 표방은 금지되어야 하고 교육의 정치적 중립을 감시하는 언론역할의 정립이 요구된다. 교육감후보의 교육(행정)경력과 정당 경력 자격 제한의 지속적인 축소 경향을 볼 때, 현행 지방교육자치 제도형성은 􋺷헌법􋺸 제31조 제4항의 취지에 미흡한 최소입법의 한계를 보인다. ｢교육기본법｣은 제5조와 제6조에서 ‘교육의 자주성, 전문성, 정치적 중립성’을 규정하였으나, ｢지방교육자치법｣ 제1조(목적)는 ‘교육의 정치적 중립성’을 누락하고 있다. 헌법의 취지를 구현하는 적극적 입법 차원에서, ｢지방교육자치법｣에 정치적 중립성을 명시하고, 교육감선거에서 후보자의 이념 표방 제한 및 언론의 정치적 중립성 준수 등 특정 단체 관련 조항을 보강해야 할 필요가 있다.

영문 초록

Article 31(4) of the Constitution guarantees the independence, professionalism and political impartiality of education. The Constitutional Court has judged that education should not be unfairly infringed or interfered by partisan biases, and that education system legalism is for not being affected by temporary specific political forces and but being intended to maintain and develop a consistent education system. Candidates for the superintendent s election, in the context of confrontation between political ideology of conservative and progressive party in the national simultaneous election, openly present political ideologies. And the media reports in a political and ideological framing manner that affects success or defeat at the polls. the candidate s political ideology being openly expressed must be banned, and the role of the media in monitoring the political impartiality of education is required. In view of the continuing reduction of educational career and political party career required for superintendent candidate, the formation of the current local educational autonomy system shows the minimum legislation rather than the proper implementation of Article 31(4) of the Constitution. The Fundamental Law of Education stipulates the independence, professionalism and political impartiality of education in Article 5 and 6, but the Local Education Autonomy Act(LEAA) omits the “political impartiality”. In the context of active legislation that implements the purpose of the Constitution, political impartiality should be specified in the LEAA. In the election of the superintendent, it is necessary to reinforce specific organization-related provisions such as restriction of the ideological representation of candidates and compliance with political impartiality of the media.
