노인주거복지법에 관한 소고

국문 초록

본 연구의 목적은 고령사회가 아니라도 노인복지 문제는 존재한다. 다만 고령사회에서의 노인복지는 양적측면에서 증가할 수밖에 없고 질적 측면에서도 복지내용이나 성격을 달리 할 수밖에 없는 것이다. 특히 노인을 위한 복지수준이 제한적이어서 실질적인 도움을 주지 못하고 있으며, 노인들이 주거생활을 영위하는데 어려움을 겪고 있다. 또한 여러 노인시설이나 인력에 대한 관리의 미흡 등 체계화되지 못한 부분이 산재되어 있다. 따라서 이제 우리나라의 현실적인 문제에 맞는 노인복지제도를 구축하기 위한 문제점을 분석하여 법제도적 대응방안이 필요하다. 또한 노인들을 위하여 생활서비스 연계, 활동지원 등 노인서비스를 제공하도록 함으로써 노인의 복지증진에 기여할 필요가 있다. 헌법 제34조 제4항은 “국가는 노인과 청소년의 복지향상을 위한 정책을 실시할 의무를 진다”고 규정하고 있다. 헌법 제35조 제3항은 “국가는 주택정책개발을 통하여 모든 국민이 쾌적한 주거생활을 할 수 있도록 노력하여야 한다”고 규정하고 있다. 노인복지법 제8조에서는 “국가 또는 지방자치단체는 노인의 주거에 적합한 기능 및 설비를 갖춘 주거용시설의 공급을 조장하여야 하며, 그 주거용시설의 공급자에 대하여 적절한 지원을 할 수 있다”고 규정하고 있다. 이는 이러한 헌법정신을 확인한 것이라 할 수 있다.

영문 초록

The purpose of this study is that enlightingments of the aging because society s playing to reduce the elderly dependency Increase and old class income secreaty or diseasing securities is becoming a difficult social problem, all sorts of senile diseases increased and the elderly raising difficulties made by the increased the elderly of the seriousness of these problems. To perfect the social security against the social risks it becomes on the one another necessary to provide elaborate systems of coordinations in the fields of social securities. It must be pursued on the dimensions if law as well as policies. On the other hand national commitments if social security benefits must be comparatively analysed to have implications for the national legislations. It becomes one of the most important facts that prepare for the advanced elderly societies which are the law of elderly man welfares and policies are divided into an employment guarantee policies, an income guarantee policies, a welfare policies. To complete the social security these are on the one hand necessary to provide an perfect systems of coordinations in the fields of social securities. It must be done
