원격화상시스템을 이용한 증인, 참고인, 미결수용자 공판절차 참가

국문 초록

증인, 참고인, 피고인 등의 소송당사자가 원거리이거나 임산부, 신체장애인, 초고령 노인이거나 바쁜 일상을 뒤로 한 채, 공판일정에 맞춰 재판에 참여하기란 여간 쉬운 일이 아닐 것이다. 특히, 구속된 피고인은 무죄추정을 받음에도 불구하고 교정시설에서 공판정 참여를 위해 이동 중 도주방지를 위해 수갑과 포승줄에 묶인 채 이동하고 있으며, 공판정 참여 시 심한 수치심과 심리적 위축이 초래되고 있다. 이러한 요건을 충족시키면서 재판의 효율성을 높일 수 있는 방법을 연구하는 것이 연구의 목적이다. 연구의 방법은 원격화상시스템 관련 선행연구를 살펴보고, 이를 바탕으로 원격화상회의시스템을 제작 운영하는 업체를 방문하여 원격화상재판시스템 구축이 가능한지를 알아보는 것이다. 운영에 따른 보안문제, 비용문제, 방어권 문제 등 다양한 문제점을 살펴보고 대응방안을 강구하는 것이다. 특히 보안문제가 해결되지 않는다면 원격화상재판시스템의 운영은 사실상 불가능할 것이다. 따라서 메인 서버를 법무부에 두고 전용회선을 각 법원에서 이용함과 동시에 보안을 강화한다면 보안상 문제는 해결할 수 있을 것이다. 연구결과 법원에 원격화상재판시스템의 구축이 충분히 가능함을 살펴보았으며, 만약 실시된다면 증인, 피고인, 참고인 등은 공판정에 직접 참여하지 않고 화상을 보면서 공판절차에 참여할 수 있으므로 시간과 비용을 절약하는 소송경제적 목적, 접근의 용이성, 재판의 효율성 등을 달성할 수 있을 것이다.

영문 초록

The litigants of witnesses, testifier and defendants will be eligible to participate in the trial according to the schedule of the trial if they are away from the court or are busy living. In particular, the arrested defendant is moving in handcuffs and cuffs to prevent escape while on the move despite being presumed innocent, and the participation in the trial is causing severe shame and psychological contraction. The purpose of the study is to study ways to increase the effectiveness of trials while meeting these requirements. The method of the study is to examine the preceding study related to the telephoto system and to visit the companies that manufacture and operate the Videoconferencing to see if it is possible to establish a telephoto trial system. They are looking at various problems such as security problems, cost problems, and defense rights issues due to the operation and working out countermeasures. The operation of a telephoto trial system will be virtually impossible, especially if security issues are not resolved. Therefore, if the main server is left at the Justice Ministry and private lines are used in each court while security is strengthened, the security issue can be solved. Research has shown that if a Videoconferencing is established and implemented in the court, witnesses, defendants, and witnesses can participate in the trial process while watching the images instead of directly participating in the trial, thereby achieving the litigation economy purpose of saving time and money and the efficiency of the trial.
