국문 초록

우리나라는 행정부와 입법부를 민주적으로 선출하는 제도는 갖추어왔으나, 검찰조직만은 수사권과 기소권이라는 막강한 권력을 지닌 조직임에도 불구하고 언제나 국민의 감시와 견제에서 벗어나 있었다. 이로 인해 검찰의 중립성과 공정성은 언제나 의심받았고 검찰조직은 결국 스스로 권력기관화하여 권력남용을 통하여 인권침해에까지 나아가고 있는 것이 현실이다. 검찰은 선출되지 않은 권력이자 견제받지 않는 권력으로 군림해 왔는바, 검찰 권력의 민주화를 위해서는 국민의 참여와 감시, 통제가 필요하다. 이를 위한 여러 가지 방안이 논의되어 왔으나, 이 논문에서는 검찰에 대한 국민의 신뢰를 민주정치의 가본 원칙 안에서 복원하기 위하여 지방검찰청 검사장 직선제 도입의 필요성과 방안을 살펴보고자 하였다. 우리나라에서의 지방검찰청 검사장 직선제 도입의 역사와 함께 미국의 검사장 선출제를 살펴보고, 제도 도입 우려에도 불구하고 지방검찰청 검사장 직선제 도입이 펼요한 긍정정 유인이 존재함을 보겠다. 지방검찰청 검사장 직선제 도입이야말로 국민에 의한 검찰개혁의 훌륭한 방안일 수 있다.

영문 초록

Even Korea has a system for democratically electing the executive and legislative branches, the prosecution organization alone has a powerful power of investigation and prosecution and has always been free from the surveillance and checks of the people. As a result, the prosecution s neutrality and fairness have always been questioned The reality is that the prosecution s organization is eventually organizing itself and proceeding to human rights violations through abuse of power. The prosecution has reigned as unelected and unchecked power, so the democratization of prosecution power requires public participation in monitoring and control. There have been many ways to do this. The purpose of this paper was to examine the necessity and the plan of introducing the linear system of the district prosecutor s office, To restore public trust in the prosecution within the basic principles of democratic politics, This paper compares the selection of prosecutors in the United States with the history of introducing the straight system of the district attorney s office in Korea, Despite concerns about the introduction of the system, it is clear that there are positive incentives that require the introduction of a straight system for the district attorney s office. The introduction of a straight system of the district attorney s office may be an excellent way of reforming the prosecution by the people.
