‘살만한 삶’과 장애인 교육권 보장에 관한 여성주의적 접근

국문 초록

이 논문은 여성주의적 이론과 접근을 통해 보다 현실적이고 실천적인「장애인차별금지 및 권리구제 등에 관한 법률」상의‘장애인 교육권 보장의 실태와 보장 방안’을 제시하고자 한다. 이와 동시에 그간의 여성주의 이론과 접근 방법을 통한 연구가 비단 여성인권의 논의뿐만 아니라, 장애인인권 등 주체가 아닌 타자로 배제되어 윤리적 폭력을 경험하는 이들의 인권 논의에 유용한 이론적 배경이 되고 있으며, 현실적인 실태 분석과 실천적인 보장 방안을 제시함에 적절함을 밝혀 보고자 한다. 따라서 최근 차별금지법 제정을 촉구하고 있는 시점에서, 앞서 2008년, 개별 차별금지법으로는 처음으로 제정되어 시행된「장애인차별금지 및 권리구제 등에 관한 법률」에 규정되어 있는 교육영역에서의 장애인 교육권 이행 실태를 파악함에 있어, 여성주의적 이론과 방법론을 활용하였다. 여성주의적 이론으로는 주디스 버틀러의 ‘살아갈 수 없는 삶’과 ‘윤리적 폭력 비판’을 바탕으로 한 ‘여성주의적 인정윤리와 판단유보’를 들고자 한다. 또한 여성주의적 접근 방법으로 장애인, 장애인 가족과 장애인 생활시설의 종사자와의 인터뷰를 통해 장애인의 교육활동을 중심으로 한 일상적인 삶의 이야기를 나눔으로써, 장애인의 교육활동 실태를 개별적으로, 상황적으로, 맥락적으로 파악하여「장애인차별금지 및 권리구제 등에 관한 법률」상의 장애인 교육권 보장 실태를 현실적으로 분석하고자 하였다.

영문 초록

In this paper, I present it, more realistic and practical「ACT ON THE PROHIBITION OF DISCRIMINATION AGAINST PERSONS WITH DISABILITIES, REMEDY AGAINST INFRINGEMENT OF THEIR RIGHTS, ETC.」, through feminist theory and approach. At the same time, I want to say that feminist theory and approach are appropriate 1) in addition to the discussion of women s rights, 2) they are a useful theoretical background for discussing human rights of those who experience ethical violence by being excluded from others, such as human rights of the disabled. 3) And I would like to confirm that they are appropriate to present a realistic analysis and suggest a practical guarantee. In 2008, the Individual Non-Discrimination Act(「ACT ON THE PROHIBITION OF DISCRIMINATION AGAINST PERSONS WITH DISABILITIES, REMEDY AGAINST INFRINGEMENT OF THEIR RIGHTS, ET C.」) was enacted and enforced for the first time. Therefore, this study used feminist theory and methodology to grasp the implementation status of the right to education for the disabled in the education area specified in this Act. This is in response to the recent urging to enact antidiscrimination laws. In the paper, feminist theories include feminist recognition ethics and defer its judgement on the other based on the Judith Butler s unlivable life and crime of ethical violence . In addition, the feminist approach was conducted through interviews with people with disabilities, families with disabilities, and workers in living facilities for the disabled. In particular, we share daily life stories centered on education activities for the disabled. In this context, this study attempted to realistically analyze the status of guaranteeing the right to education for persons with disabilities under the Act on the Prohibition of Discrimination and Rights Relief(「ACT ON THE PROHIBITION OF DISCRIMINATION AGAINST PERSONS WITH DISABILITIES, REMEDY AGAINST INFRINGEMENT OF THEIR RIGHTS, ETC.」).
