국문 초록

황산덕 교수는 법철학과 국제사법 및 형법 교수로서, 또한 행정가로서, 여러 뛰어난 업적들을 남긴 인물이다. 이 글에서는 그 중에서도 형법학의 영역에서 이룩된 학문적 성취에 주목하여, 그 발자취를 따라가 보았다. 황산덕 교수는 법철학적 관점에서 형법학의 이론체계를 구축하려 한 학자였다. 그러한 측면에서 볼 때 벨첼의 목적적 행위론은 황산덕 교수의 형법학에서 핵심적인 위치를 차지하고 있다. 이 글에서는 형법총칙 분야 중에서도, 목적적 행위론과 연관된 쟁점들을 중심으로 황산덕 교수의 학문세계를 탐구하여 보았다. 그 구체적인 대상이 되었던 논점들은, 죄형법정주의, 구성요건과 위법성의 관계, 인과관계, 위법성 이론과 사회상규 및 인격적 불법개념, 주관적 불법요소와 고의, 형법 제16조가 규정한 “정당한 이유”의 해석론, 책임의 근거, 공동정범 등이다. 황산덕 교수의 학문세계가 새로운 조명을 받고, 그의 형법학에 대한 연구가 활발히 이루어지게 되는 것에 대해, 본 논문이 하나의 계기가 되기를 기대한다.

영문 초록

As a professor and administrator in the philosophy of law, private international law, and criminal law, Professor Hwang San-duk had many accomplishments in his life. Among his notable achievements, this paper focuses on his academic achievements, and traces his legacy in criminal law. Professor Hwang San-duk was a scholar who attempted to establish a theoretical system for criminal law from the perspective of philosophy of law. In this context, Welzel’s teleological theory of action played a key role in Professor Hwang San-duk’s undertakings in criminal law. This paper explores Professor Hwang San-duk’s scholarly outlook with a focus on issues related to the teleological theory of action under general provisions of criminal law. The issues were namely the principle of legality, relationship between concrete facts and unlawfulness, cause and effect, theory of unlawfulness and social rules, concept of personal unlawfulness, subjective unlawful elements and intent, interpretation of “reasonable grounds” in Article 16 of the Criminal Act, basis of responsibility, and joint principal offender. The findings of this paper are expected to draw attention to the scholarly views of Professor Hwang San-duk and to promote further research on his theories of criminal law.
