대학 내 성폭력사건 처리절차의 문제점과 개선방안

국문 초록

대학 내에서 발생하는 성폭력사건을 상담하거나 조사를 진행하다고 보면 피해자에 대한 보호는 신속하게 이뤄지며 보호를 위해 가해자와의 격리나 직무배제 등의 조치는 매뉴얼에 따라 적절히 진행되고 있다고 보여 진다. 그러나 성폭력사건의 가해자로 지목되거나 추정되는 대학 구성원(피신고인)에 대한 조사는 적절한 방법으로 이뤄지고 있는가에 대해서는 의문이 든다. 그것은 가해자를 조사하거나 증거를 수집하는 절차가 학내에 세밀하게 규정되어 있지 않거나 관련 규정을 마련하기 위해 참고할 만한 상위법이나 지침이 마련되어 있지 않기 때문이다. 피신고인이 일방적으로 조사의 대상자가 되며 실질적으로 자신을 방어할 수 있는 절차가 보장되어 있지 않다면 이 또한 가해자에 대한 또 다른 인권침해가 될 여지가 있다. 성폭력범죄을 예방할 수 있는 가장 좋은 방법은 물론 성폭력에 대한 적절한 교육이겠지만, 그와 동시에 성폭력범죄가 발생한 경우 공정하고 적절한 조사 절차가 마련되어야 할 것이다. 이러한 조사과정을 통해 나온 징계라야 가해자도 진정으로 반성하고, 그 처분을 수긍할 수 있으며, 궁극적으로 재발방지의 효과도 기대할 수 있을 것이다. 현재 대학 내 성폭력 사건을 처리하는 절차나 매뉴얼이 아직은 미흡하지만 피해자에 대한 보호만큼이나 가해자 혹은 가해자로 추정되는 대학 구성원에 대한 관심과 논의도 절실히 필요한 시점이다.

영문 초록

When the sexual assault and misconduct were investigated, the university took action promptly measures to protect complainants or victims, offender was expelled from the task or duties according to the manual. However, it is wonder that the investigation is appropriate to respondents or offenders. Because disciplinary procedures for investigating or collecting evidence is not specified clearly by the university and there are no laws or guidelines as a instruction. In this paper, we will explain the process of investigating the sexual assaults and misconducts and collecting evidences, when sexual harassment happened in the universities. In addition, this study examine that how procedures of interviewing complainants and respondents and protection are appropriate to show approval of disciplinary procedure of university. The aim is to provide manuals or guidelines that, if necessary, apply the criminal procedure law or rules to secure rights to be treated with respect, dignity, sensitivity and fairness throughout the entire process for complainant and respondent. The best way to prevent sexual violence is, of course, prevention education of sexual violence, but at the same time, it is need for respondents to give an opportunity to bring an advisor or counsel for providing advice to the students. Only the consequences of disciplinary action in accordance with due process can enable the respondents to understand and accept on the consequences, and expect the effect of preventing recurrence. Although the procedures and manuals for dealing with sexual violence in the university are still insufficient, the interest and discussion about fairness procedure for the perpetrator or the respondent is as much as the protection of the victim.
