평화적인 집회시위문화의 정착방안에 관한 연구

국문 초록

본 연구는 집회시위에 대한 논문으로서 경찰과 시민들에 대한 인식조사를 실시해 보고, 향후 평화적인 집회시위문화를 위한 대안을 모색하는데 목적이 있다. 이를 위하여 대구 중구와 수성구, 경북 포항과 구미경찰서에 근무하는 경찰관과 해당 지역주민을 대상으로 설문조사를 실시하였으며, 설문자료는 시민 220부와 경찰 250부를 활용하였다. 설문지는 크게 집회시위 문화, 집회 시위법, 집회시위에 대한 경찰의 대응, 집회시위에 따른 피해, 집회시위에 대한 피해 보상 등으로 구성하였다. 자료의 분석결과는 다음과 같다. 첫째, 평화적인 집회시위문화의 정착을 위해서는 타인의 권리를 존중하면서 자신의 권리를 주장하는 민주시민으로서의 자질과 준법의식을 갖출 수 있도록 지속적인 교육이 이루어져야 한다. 둘째, 불법·폭력 시위를 주최한 주최측이나 참가자들에게 적극적으로 손해배상을 청구해야 하며, 불법 과잉대응 경찰관에 대한 엄중한 처벌이 이루어져야 한다. 셋째, 경찰과 집회참가자, 시민 모두가 공감대를 형성할 수 있는 매뉴얼의 개발을 통해 경찰은 법집행에 일관성을 유지하고 집회참가자들은 공동 매뉴얼을 활용할 수 있어야 한다. 넷째, 집회관리체계와 객관적 평가의 순환시스템을 형성하고, 피드백이 이루어져야 한다. 마지막으로 사회갈등조정 장치를 마련하고 지역사회 등에서 신망 있고 존경받는 인사들의 적극적인 참여와 개입을 유도할 필요가 있다.

영문 초록

This study is to mass demonstrations and protests for commence to investigate alternatives for the purpose to explore the culture. To this end, Daegu Suseong-gu and Jung-gu, Gyeongbuk sphere of Pohang and Gumi, police officer working on appetite and with that it has conducted a survey aimed at the local population. The data conducted to 220 citizens and 250 police officers in Daegu, Kyongbuk area was analyzed. In this context, The result is following: First, the peaceful gathering protest culture while respecting the rights of others in order to settle her rights as a citizen of the alleged qualities of the democratic and law-abiding consciousness must be made sustainable so that they can qualify as education. Secondly, illegal and violent protests by the organizers or participants must actively respond to claims for damages, the excess must be severe punishment for the police officers. Third, police and rally participants, Citizens can form a consensus everyone through the development of manuals for the police to maintain consistency in law enforcement and you should be able to take advantage of their joint rally participants manual. Fourth, the objective evaluation of the management system and the rally forms the circulatory system, the feedback should be done. Finally, social conflicts, such as the adjustment device and highly respected figures in the community trust and the active participation of and there is a need to provoke the intervention.
