국문 초록

급변하는 사회변화와 영향은 우리의 생명과 재산을 보호하는 치안환경에도 지대한 영향을 미치고 있어서 보다 다양화된 각종 범죄가 날로 증가하고 있는 반면, 현재의 경찰력만으로 민생치안의 문제를 대처하고 극복하기에는 분명 한계를 드러내고 있다. 따라서 이러한 문제들을 해결·보완하기 위한 민간조사 제도가 신속히 도입되어야 하며 현재 시행상 문제가 되고 있는 민간 조사원의 업무 범위, 관리 주체, 사생활 보호방안이 다음과 같이 정립되어야 한다. 첫 번째로, 민간조사원의 업무 범위와 한계를 명확히 설정해야 한다. 두 번째로, 민간조사원의 시행 시 관리감독의 주체를 현실성과 효율성을 고려하여 선정하여야 한다. 세 번째로, 민간조사원 활동 시 사생활 침해 예방을 위한 제도적 방안이 강구되어야 한다. 따라서 현재의 심부름센터, 흥신소 등의 불법행위와 사생활침해를 예방하고 박근혜정부의 「신직업 육성추진」의 일환으로 민간조사원 제도의 신속한 법제화 추진이 요구된 만큼 주요쟁점사항에 대한 정리가 관련 부처 간 최단시간 내 정리가 되어 국민의 수요요구에 양질의 서비스가 제공되길 바란다.

영문 초록

The changing current of society effects on the public peace environment, which protect our lives and prosperity. The current police force can’t deal and overcome enough the various and complex public peace problems, whereas the variety of crime is increasing. The private investigator system must be introduced. We must establish the problem on the scope of work of the private investigator , the entity in charge of management of the private investigator and the protection of privacy solution along with following. Firstly, the scope and limit of private investigator must be established clearly. Secondly, the entity in charge of management must be selected with due regard to reality and efficiency. Thirdly, the institutional device must be adopted to protect the invasion of privacy. Therefore the private investigator is demanded to be legislated into institute in order to root out the illegal business of the detective agency and prevent the invasion of privacy. It supports the slogan [The job raising promotion], which Park -Gun Hye government is pushing ahead. I hope the system of the private investigator will be served to people with the good quality in accordance with the demand of people throughout discussing with the ministries in charge of that it.
