국문 초록

경찰경호 업무는 경찰관직무집행법에 ‘주요 인사 경호’로 규정되어 있듯이 경찰 본연의 중요 임무이며, 경찰은 대통령과 외국국빈 방문 그리고 경찰책임 대상의 경호행사를 위해 국가경호기관으로서 대통령 경호실보다 더 방대한 인력과 경찰 전체 기능이 총망라한 경호활동을 펼치면서 사실상 경호활동의 대부분을 수행하고 있음에도, 현행 경호에 관한 일반법이라고 할 수 있는 대통령 등의 경호에 관한 법률은 경호실에 주체성을 부여하고 있고 경찰은 단순한 협조기관으로만 보고 있으며, 경찰도 훈령인 경호규칙에 의해 경호활동을 수행하는 등 법적 지위가 명확하지 않은 문제점이 있으며, 경찰의 경호조직을 체계적으로 관리․발전시키고, 경호현장에서 불가피하게 국민의 권리를 제한하는 교통․출입통제 등 국가공권력 행사의 오․남용 방지와 정당성 확보를 위해서도 경찰경호 일반법의 제정은 필요하다. 이러한 문제점을 개선하고자 지난 17대 국회에서 경찰경호 일반법 제정이 추진되었는데 국회차원에서는 국가주요 인사에 대한 경찰경호 일반법 제정의 필요성을 인정하였으나, 정부차원에서 단일의 통일된 법안 제정을 추진하면서 경호실의 반대로 무산된 그 과정과 법안의 주요 내용을 살펴보았다. 경찰경호 일반법 제정은 재추진되어야 하며, 법안에는 경찰의 경호대상을 국내요인과 국외요인으로 구분하여 규정하고, 지방경찰청장 등 경찰기관장의 경호책임을 부여하며, 국가기관․자치단체․군 등 관계기관과의 협조요청 권한, 경호안전구역 설정 권한, 경호상황본부 운영, 경호목적상 필요한 경우 교통관리․출입통제․위해방지에 필요한 안전활동 권한, 총포류의 사용금지 및 임시영치, 경호목적상 위해 우려자에 대한 일시격리 등 긴급조치권, 무기사용에 있어서 경찰관직무집행법보다 완화된 규정의 적용, 경호장비의 종류 및 사용기준 마련, 경찰경호위원회의 설치․운영, 직권남용과 비밀엄수 등의 규정을 담는 것이 바람직하다고 본다.

영문 초록

Police security services is a critical mission of the police as it is defined as ‘Key Personnel Security’ in Act on the performance of duties by police officers. The present general security law, that is, Presidential Security Act, etc. provides the identity to the Presidential Security Service and considers the police just as a simple cooperative agency. In addition, the police’s legal position is not clear for security as it just follows the security rules in the instructions. In order to solve the concerns, police security general law legislation was raised in the 17th congress meeting. The necessity of police security general law legislation for key national personnel was recognized in the National Assembly level. However, the law became invalid because of the objection of Presidential Security Service. The legislation of the police security general law should be restarted. In the legislation, the targets for security should be classified into domestic and foreign factors. The responsibility to security should be charged to the heads of police agencies such as local police station head, etc. The right to request cooperation to relevant agencies like national agencies, local groups, etc. , the right to designate security safety zone, escort situations operated by the head office, if required for security purposes traffic control and entry/exit control, safe activities required to prevent damages, firearms prohibition, temporary keeping, emergent measures like temporary isolating the concerned for escort, etc. , relieved regulations application for arms use than the police duty execution law, arranging the types of security devices and standards of using them, installing and managing the police security committee, regulations for confidentiality, abuse of authority, etc. should be contained., which is considered desirable.
