범죄피해자 보호와 응급구조사의 역할 강화 방안

국문 초록

구급차와 응급실, 중환자실, 일반병실로 이어지는 구조에서, 진료가 반드시 응급실을 포함한 병원에서 이루어져야 한다는 생각에서 조금만 벗어나면, 병원 전 진료의 중요성을 새롭게 깨닫는 계기가 될 수 있다. 빨리 꿰맬 수 있는데도 굳이 지혈을 한 채 응급실에 도착하기를 기다릴 이유가 없다. 응급의료 인력이 부족하다면 다른 인력을 재교육해서라도 응급의료에 투입하는 방안을 검토할 필요가 있다. 과학기술의 발달로 의료지도 수단도 다양해진 마당에 구급차 내에서 가능한 치료의 범위 역시 넓혀가야 한다. 그런 의미에서 응급구조사 외에 중환자 응급구조사, 선임응급구조사, 간호사 등 전문성이 보다 강화된 인력을 탑승시키는 외국의 사례를 참조할 필요가 있고, 현상유지 위주의 지침에서 벗어나 필요한 치료를 적시에 행할 수 있는 응급의료의 선진화를 모색할 때가 되었다고 본다. 의료적 관점에서 볼 때 초동단계에서 해야 할 일이 점점 더 많아지는 추세에 있다. 응급의료 인력에 대한 교육과 재교육을 강화해서 중요한 처치까지도 할 수 있게 해 주고, 구급차에서 얻은 정보가 응급실, 중환자실, 일반병실로 이어지는 의료체계에서 적절하게 활용될 수 있는 구조를 만들어 갈 필요가 있다. 응급구조사의 역할은 거기서 그치지 않는다. 가해자를 처벌하는 데 필요한 결정적 증거를 제공할 수 있다. 우리 형사소송법은 응급구조사가 기억하는 진술이나 녹음한 파일 등을 증거로 쓸 수 있는 길을 열어놓고 있다. 구급차 내에서 들리는 작은 소리라도 흘려듣지 않고 기록해 둘 필요가 있다. 응급구조사는 범죄피해자의 편에서 범죄에 맞서는 사람이라는 점을 잊어서는 안 된다. 병원까지 빨리 가는 것에만 관심을 갖다 보면 많은 것을 놓칠 수 있고, 그렇게 놓친 것 가운데는 나중에 다시 찾을 수 없는 것도 있다. 증거수집의 주체로서 응급구조사의 역할이 더욱 중요해지고 있다.

영문 초록

Article 27 of ‘Medical Act’ of Korea states that only medical personnel including physicians and nurses can perform medical practice and that they should provide medical assistance within the area certified by the government. This principle also applies in the emergency medical practice area and every emergency medical technicians (EMT) should not be engaged in medical performance without the direction of medical personnel. Two exceptions to this principle are concerned with the situations where EMTs couldn’t get the medical direction due to communicational problems and that the Regulation of the Health Department permits to do in advance. The Korean medical emergency system lacks efficiency in terms of responding to the needs of criminal victims. Victims hope that the ambulance could be the starting point of medical treatment and their injuries and sufferings are quickly suppressed by the hands of EMTs. However, our system considers the emergency ambulance as just one of transportation facility to reach the Hospital. The notion of the pre-hospital care center could not get the support from the public because of the belief that EMTs should not be confused with emergency medical personnel working in hospitals. All these lead us to think about what is the role of EMT in the technically and medically developed world. We believe that EMTs should be trained to be highly competitive health care providers at the pre-hospital stage. They are struggling to save criminal victims in the critical moment without much of golden-time left. They need to be equipped with more developed medical tools and skills, and every support should be given to them for their efficient performance. Furthermore, under the current Evidence law principles and practice in the States and Korea, EMTs should take the role of hearsay witnesses. It is true after Crawford and regardless of Confrontation Right challenge. EMTs have many things to do for victims so we have every reason to count on them in the pre-hospital struggle.
