외국인 범죄피해자 지원 실태 및 개선방안

국문 초록

외국인은 범죄피해에 매우 취약한 집단임에도 불구하고 외국인 범죄피해 실태는 물론 외국인 범죄피해자의 지원 및 보호 관련 실태 역시 제대로 파악되어 있지 않다. 이에 이 연구에서는 외국인 범죄피해자의 지원 및 보호 관련 실태를 파악하기 위하여 ‘범죄피해자지원센터’의 외국인 범죄피해자 지원 사례를 통하여 외국인 범죄피해자 보호 및 지원 현황을 살펴보고 현행 외국인 범죄피해자 관련 지원 정책의 문제점과 그 개선방안을 제안하였다. 전체 ‘범죄피해자지원센터’ 범죄피해자 신규 접수인원 중에서 외국인 범죄피해자가 차지하는 비율은 2015년도에는 0.8%(97명), 2016년도에는 0.7%(77명)로써 국내 체류외국인의 비율이 4% 이상인 점을 감안하면 매우 낮은 상태이다. 외국인 범죄피해자 보호 및 지원을 확대하기 위해서는 무엇보다 ‘범죄피해자지원센터’에 대한 외국인 범죄피해자의 접근성이 확대되어야 하며, 정책적으로는 경찰의 범죄피해자 지원 제도 고지 및 안내의 활성화, 가해자가 외국인인 범죄피해에 대한 지원, 그리고 불법체류 외국인 범죄피해자에 대한 지원 등 외국인 범죄피해자 지원정책의 제도적 개선이 필요하다.

영문 초록

Foreigners are particularly vulnerable to victimization by crimes. Despite this fact, in Korea, not much attention has been accorded to the reality of crime victimization of foreigners and the support and protection currently available for foreign victims of crimes. To address this issue, this study looks into the protection and support for foreign victims of crimes that are currently provided by such institutions as Crime Victim Support Centers, and carries out a case study on crime victimization of foreigners to identify the issues with the current support and protection policies for foreign victims of crimes and possible ways to improve them. This study analyed the data on support provided to 87 foreign victims of crimes by 59 Crime Victim Support Centers across Korea for a two-year period(2015 and 2016). In 2015 and 2016, the percentage of victims of foreign crime among all new applicants of Crime Victim Support Centers across Korea were 0.8%(97foreigners) and 0.7%(77foreigners), respectively. This ratio is very low compared with the ratio of foreigners staying at 4% or more. In order to expand the protection and support of foreign victims of crimes, it is necessary to improve support policies, such as the promotion of notice and guidance of crime victims support system in police investigation, support for foreign victims of crimes committed by foreigners, and support for foreign victims of crimes in illegal staying.
