반영구화장 법제화에 관한 탐색적 연구

국문 초록

국내의 반영구화장은 이미 세계적으로 높은 기술력을 가지고 있으며 해외에서도 이를 인정하고 자연스럽고 높은 완성도의 시술과 교육을 받고자 국내를 방문하고 국내의 전문가를 찾는 실정이다. 그럼에도 불구하고 반영구화장은 세계적으로 한국에서만 유일하게 불법으로 내몰리며 이러한 법의 모호성 때문에 논란의 소지가 여전하다. 이는 1992년 반영구시술을 의료행위에 해당한다고 대법원판결문에는 판시하였으나 이후 헌법재판소는 1996년에 문신시술은 의료행위에 포함시키지 않는다는 모호한 결정을 내렸다. 지속적인 논란 속에 2018년 6월 반영구화장 합법화, 법제화를 위한 K뷰티 일자리창출 정책 토론회를 통해 반영구화장은 정부의 세수 확보, 청년일자리문제 및 무엇보다 K뷰티산업발전에 큰 영향을 주는 분야로 부각되었다. 이러한 사실을 근거로 법 개정을 통해서 이를 법제화를 시키자는 주장에 힘이 실리며 반영구화장에 대한 관심과 보다 많은 연구의 필요성이 제기 된다. 반영구화장의 법제화를 위해 미용관련 고등학교 및 대학교에서는 반영구화장에 대한 체계적인 교육과정의 신설이 필요하다. 시술환경과 시술자의 감염 및 위생관리뿐만 아니라 안전관리에서 비롯된 시술절차에 대한 체계적인 교육과정의 확립이 필요하며 국가기술자격제도화에 대한 대비와 신뢰성 제고를 위해 직무분석을 통한 시술자 교육 및 배출과정에 대한 명확한 규정제정이 필요하다. 위생과 안전을 중요시하는 법제화되고 제도적 장치를 갖춘 외국의 사례를 볼 때 정확하고 명확한 교육과정을 이수하지 않은 국내의 현 시술자들에 대한 위생과 안전에 대한 재교육과 지속적인 보수교육에 대한 시행이 필요하다할 수 있다. 본 연구는 반영구화장과 법제화에 관한 문헌과 선행연구의 고찰을 통해 분석하고 미용영역의 한 분야로 전문적 기술인정과 법제화 방안을 모색하는데 도움이 되고자 한다.

영문 초록

Korea s semi-permanent makeup has high technology of world-class high, so it is being handled with interest in foreign countries. In order to receive high-quality education, natural and high perfection, foreigners who are visiting Korea and looking for Korean practitioners are increasing. Nonetheless, semi-permanent makeup is the only illegal in Korea and is still controversial due to the ambiguity of the law. In 1992, the Supreme Court ruled that semi-permanent treatment was a medical act, but in 1996, the Constitutional Court had ambiguity not to include tattooing in medical practice. With constant debate in June 2018, semi-permanent makeup legalization and policy debate on the creation of K beauty jobs for legalization has made a significant contribution to the recent youth employment problem, securing of tax revenue and K beauty industry development. There is a force in the claim to legalize. In order to legislate semi-permanent make-up, it is necessary to establish a systematic curriculum for semi-permanent make-up at high schools and universities related to beauty. It is necessary to establish a systematic curriculum for the procedure of that stem from the safety management as well as the infectious and hygiene management of the treatment environment and the practitioner. In order to prepare for the institutionalization of the national technical qualifications and to improve the reliability, Clear rules are needed. In the case of foreign countries with legislative and institutional arrangements that emphasize hygiene and safety, rehabilitation of hygiene and safety for the current practitioners in Korea who do not have an accurate and clear curriculum, The purpose of this study is to analyze the existing semi-permanent makeup shoe making research and semi-permanent makeup is a field of beauty area.
