자유학기제의 성공적 추진을 위한 헌법적 쟁점 분석

국문 초록

본 연구의 목적은 자유학기제의 성공적 추진을 위한 헌법적 쟁점들을 분석하는 것이 다. 본 연구의 방법은 문헌 고찰이다. 본 연구의 주요 결과는 다음과 같다. 첫째, 학생의 교육권을 보장하기 위하여 자유학기제는 모든 학교에서 희망하는 학생들만을 대상으로 그들이 선택하는 시기에 실시하여야 한다. 둘째, 의무교육의 무상 범위에 비추어볼 때 자유학기제를 정규 교육과정으로 운영할 경우 그 비용은 무상으로 하여야 하나, 자유학기제의 실시 여부를 단위학교가 자율적으로 결정할 경우 야기될 수 있는 형평성 문제를 해결하여야 하고, 자유학기제를 정규 교과 외 교육과정으로 운영할 경우 유상으로 할 수 있으나 저소득층 자녀들의 자유학기제에의 참여 기회를 보장하기 위하여 필요한 비용을 국가 및 지방자치단체가 부담할 필요가 있다. 셋째, 교육의 기회 균등을 보장하기 위하여 국가 및 지방자치단체는 농어촌 및 도서 벽지 지역에 자유학기제의 실시를 위한 교육조건을 정비하여야 한다. 끝으로, 일반교사와 진로진학상담교사의 전문성 신장 노력이 필요하다.

영문 초록

The main purpose of the study is to explore the constitutional issues arising in the successful implementation of the free semester system. The research method of the study is a literature review. The major findings of the study is as follows. First, to assure the student`s right to education, the free semester system should be implementedfor only the students who want to participate in this system in all schools during the semester that they want. Second, if the free semester system will be implemented within the regular curriculum, its cost should be free. In this case if the school, not the student, will choose whether this system will be implemented, the equity issue should be considered. If the free semester system will be implemented in the form of the extra-curriculum, its cost should not necessarily be free. To assure the students from the families with the low socio-economic status the opportunity to participate in this system, the central and local governments should support the cost for their participation in this semester. Third, to assure the equal educational opportunity, the central and local governments should improve the educational environment in the rural and urban areas for implementing the free semester system. Last, there should be some governmental actions for promoting the professionalism of both the general teachers and the career guidance teachers.
