대학구조개혁 촉진을 위한 법제도 정비 방안 연구

국문 초록

이 연구는 대학구조조정의 필요성에 터하여 필요한 관련 법제도의 정비방안을 모색 함을 목적으로 한다. 이를 위해 먼저 현재의 우리나라 대학구조조정 관련 법제 현황과 함께 실재적인 구조조정 실태를 살펴보았다. 이 과정에서 구조개혁의 근본적인 목적은 단순한 입학정원의 조정이 아니라 대학의 경쟁력강화에 있으며, 구조개혁의 한계로 헌 법에서 보장하고 있는 학문의 자유가 있음을 확인하였다. 아울러 구조개혁의 방향을 크게 첫째 시장원리에 따라 사립대학 스스로 자율적인 구조조정이 이루어지도록 법제도와 절차를 마련해 주는 것, 둘째 자율적인 구조개혁의 성과가 미흡한 경우에 정부가 경쟁력 이 낮은 대학에 대하여 단계별로 적절한 구조개혁을 실행할 수 있는 법제도를 마련해주 는 것으로 도출하였다. 이러한 두 단계의 구조개혁 방안에 근거하여 각각의 경우에 있어 구조개혁을 촉진하기 위한 법제도와 절차에 관한 사항을 구체적으로 제시하였다.

영문 초록

This The purpose of this study is to arrange relevant law system maintenance plans to accelerate university structural reforms. For this, the current substantive restructuring status of domestic universities and related legislation were examined. In this process, it was confirmed that competitiveness reinforcement of domestic universities is the fundamental purpose of structural reforms, not mere adjustment of entrance quota of the university, and also the academic freedom guaranteed by the Constitution has been the limitations of university structural reforms. The direction for university structural reforms was drawn as follow. First, government should prepare law system and procedures to help the private university achieve its autonomous restructuring by itself. Second, it has to provide a particular enforceable law system and procedures to less competitive universities, whose performance of structural reforms is insufficient, in order to help them implement phased proper structural reforms. Based on these two phases on the structural reform plans, information of law system and procedures to accelerating structural reforms of the University was presented in detail for each case.
