국문 초록

부동산경매 실무절차에 있어서 유치권의 문제점과 대책에 관한 연구 부동산경매에 성공하기 위해서는 부동산경매물건에 복잡하게 얽혀 있는 부동산에 관한 법률적인 이론과 실무적인 내용을 파악하여야 하는데 부동산의 실체적인 상황을 인식하고 파악할 수 있는 적절한 지식과 정보를 분석할 수 있는 능력을 갖추어야 실패하지 않는다. 부동산경매실무절차에 있어서 일반인들이 경매에 참여하기에는 아직도 많은 함정이 있어 충분한 사전조사와 경매에 관한 전문적인 지식이 없이 입찰에 참여하였다가 여러 가지 함정에 의하여 불측의 피해를 보는 경우가 허다하다. 이러한 피해를 미연에 방지하기 위해서는 경매의 절차에 있어서 주의해야 할 사항 및 권리 분석의 전문적인 지식이 요구된다. 경매물건의 함정 중에서 특히 법정지상권, 예고등기, 유치권 등은 입찰자에게 경매물건을 매수하는데 어려움이 많이 있다. 유치권의 신청이 일반화되고 다양화되므로 인하여 경매실무절차에서 유치권에 관한 많은 문제점이 대두되고 있다. 이에 본 연구에서는 우리나라 부동산경매 실무절차에 있어서 유치권에 관한 문제점을 분석하여 그 개선방안을 제시하고 경매업무관계자나 이해관계인 등 경매를 연구하는 분들에게 도움을 주고 진정한 유치권에 관한 문제점과 대책을 제시하여 경매절차의 안정성과 건전한 경매제도의 활성화가 이루어지고, 대중화 될 수 있도록 하는 방안을 제시하고자 한다.

영문 초록

STUDY　ON PROBLEMS AND MEASURES OF LIEN IN THE PRACTICAL PROCEDURE ABOUT REAL ESTATE AUCTION In order to achieve in real estate auction, you should understand the legal theories and the practical matters on real estate intricately entangled real estate auction articles, and so if only you can prepare a lot of appropriate knowledge and information understandable the substantive conditions of real estate, you never fail in that field. In the practical procedure about real estate auction, most general tenderers has still many pitfalls in participating the auction, therefore it happens to experience so much unpredicable demage caused by various blind points with the result of participation in a tender without preparing sufficiently prearranged investigation and technical knowledge. In order to prevent from these types of demage, you are necessarily required to have some watchful details in the procedure of auction and technical knowledge on the analysis of title[right]. Particularly surface rights, advanced registration, lien etc. among some blind points of auction articles are frequently troubled to the tenderer in taking over the auction article. By being generalized and diversified the applications of lien, many problems on lien in the practical procedure about real estate auction become a prominent figure. Hereupon on this study I really intend to present the improved devices by analyzing the problems in the practical procedure about real estate auction and to help some auction businessmen or such as the party interested inclusive of the concerned for studying auction. And besides I want to propose many problems and countermeasures on lien and that way I am willing to present the plans to be realized and popularized the stability of real estate auction procedures and the sound revitalization of auction system.
