국문 초록

디자인의 기능성을 판단하기 위한 자료로, 가장 많이 활용되는 것은 대체디자인의 존재여부이다. 이 테스트의 장점은 기능성 원리의 정책적 목적을 고려한 법률상 기능성 판단에 부합한다는 점이다. 또한, 대체디자인이 존재하는지 여부에 대한 객관적인 판단이 가능하다는 점에서 법 적용의 예측 가능성을 가져올 수 있다는 장점이 있다. 한편, 대체디자인 테스트의 중요한 문제점으로, 대체 가능한 형태가 극히 소수인 경우에 단일의 경제주체가 대체 가능한 모든 형태를 디자인 등록하여 기능을 실질적으로 독점할 수 있다는 점이 지적된다. 그러나 대체 가능한 형태가 극히 소수인 경우에 대체 가능성이 없는 경우에 포함시킴으로써 이러한 문제를 해결할 수 있다. 대체디자인 테스트에서 가장 논란이 되는 ‘기능’의 해석과 관련하여, 여기서의 기능을 ‘특정의 구체적 기능’이 아닌 등록디자인의 물품이 가지는 ‘일반적 기능’으로 해석하는 것이 타당하다. 물품 외관의 구체적인 치수, 크기 등은 디자인을 한정하는 요소가 아니므로, 그러한 요소들이 가지는 ‘특정의 구체적 기능’을 기능성 판단에서 고려할 필요가 없다. 대체디자인이 물품의 실용성에 부정적인 영향을 끼치는지 여부는 디자인의 기능성 판단에서 고려할 필요가 없다. 등록디자인이 대체디자인에 비하여 약간의 실용성이 있다는 이유로 등록을 무효시키거나 그 권리범위를 축소시키는 것은 바람직하지 않다. 물품 외관의 전체에 대하여 대체디자인이 존재하지 않으면 그 디자인은 등록받을 수 없다. 그러나 물품 외관의 일부에 대하여 대체디자인이 존재하지 않으면, 등록은 가능하나, 디자인의 유사판단에서 그 중요도가 약한 것으로 평가된다.

영문 초록

The existence of alternative design is the most important material to judge the functionality of the design. The alternative design test can meet the policy objectives of functionality doctrine and is consistent with de jure functionality. In addition, it can lead to predictability of law application in that objective judgment can be made. One of the problems with alternative design test is that in the case of very few alternative forms, a single economic entity can register all possible substitutes to substantially monopolize the function. However, this problem can be solved by including it in cases where there is no alternative design, if there are very few alternatives available. Regarding the meaning of function which is hard to define in alternative design test, it is proper to define the function as general function of the product of registration design, not specific function . Since the specific dimensions, sizes, etc. of the appearance of a product are not the elements that define design rights, there is no need to consider the specific functions of such elements in functionality. Whether the alternative design has a negative effect on the function of the product need not be considered in the functionality of the design. It is not desirable to invalidate a registration design or reduce the scope of rights because a registration design is somewhat more practical than an alternative design. If there is no alternative design for the entirety of appearance of the product, the design can not be registered. However, if there is no alternative design for a part of the appearance of the product, registration is possible, but the weight of that part is considered low in the judgment of infringement.
