국문 초록

연구목적: 중국의 비시장경제지위 인정 만료시한이 도래되면서 개정된 미국의 반덤핑 규정 중 PMS 관련 규정과 사례 분석 및 EU의 반덤핑규칙의 개정 내용 및 사례 분석을 통하여 우리나라의 대응방안을 모색하고, 시사점을 도출하여 피제소기업의 입장과 정부의 관점에서 취할 수 있는 조치를 제시하여 선제적 대응을 할 수 있도록 함에 연구목적이 있다. 논문구성/논리: 본 논문은 총 5개장으로 구성되어 있으며 제1장은 서론으로서 연구의 배경과 연구목적을 기술하고 있으며 제2장은 미국의 특별시장상황(PMS) 관련 개정 배경 및 주요내용을 분석하였고, 제3장은 EU의 시장왜곡상황의 반덤핑규칙의 개정 내용 및 사례를 분석하고 있다. 제4장은 PMS 적용시 우리나라의 대응방안을 모색하였고 제5장은 시사점을 도출하였다. 결과: 미국은 ‘AFA’, ‘PMS’ 등을 활용하여 무역구제조치를 자의적으로 집행하고 있다는 국제사회의 비난적 여론이 형성되고 있으며, 우리나라도 피해를 보는 당사자의 입장에서 강력한 문제제기가 필요하다. EU도 중국 NME 지위 만료 가능성에 대한 사전예방책으로 ‘중대한 왜곡’이란 개념의 도입을 통해 유사한 수준의 무역구제조치를 취할 수 있는 방안을 모색하고 있다. 이러한 방식이 기존의 시장경제국에 어떻게 적용될지 아직 미지수이나 비시장경제국에 대한 덤핑마진 산정방식과 유사한 방식을 시장경제국에 적용할 가능성을 배제할 수는 없는바 선제적으로 준비해둘 필요가 있다. 독창성/가치: 미국과 EU의 무역구제조치가 자의적으로 취해질 개연성이 높아지고 있는 시점에서, PMS를 구체적으로 국내법에 규정하고 있는 미국과 EU의 제도의 개정내용과 적용 사례를 분석하여 이에 대한 비판과 논쟁의 중심에 있는 PMS, AFA 적용 시 우리나라의 대응방안을 제시하여 차별화를 두었다.

영문 초록

Purpose: As the deadline for expiration of China s non-market economic status has arrived, the US antidumping regulations have been revised and analyzed in the case of PMS regulation and case analysis and EU anti-dumping regulations. The purpose of this research is to provide preemptive responses by suggesting measures that can be taken from the viewpoint of the complainant and the government. Composition/Logic: This paper is composed of 5 chapters. Chapter 1 describes the background and purpose of the study as an introduction. Chapter 2 analyzes the background and contents of the revision of the special market situation in the US (PMS) Of the antidumping rules of market distortions in the market. Chapter 4 explored the countermeasures of Korea when applying PMS and suggested the implications in Chapter 5. Findings: The United States has been criticized by the international community for its arbitrary enforcement of trade remedy measures using AFA and PMS , and it is also necessary for Korea to take a stronger position in terms of the victims. The EU is also looking for ways to take similar remedies by introducing the concept of serious distortion as a precautionary measure against the possibility of expiring NME status in China. It is not yet clear how this approach will apply to existing market economies, but it is not possible to exclude the possibility of applying them to market economies in a manner similar to the dumping margin calculation method for non-market economies. Originality/Value: At the time when the likelihood that the US and EU trade remedies will be taken arbitrarily is increasing, the amendments and application cases of the US and EU systems that specifically specify PMS in domestic law are analyzed, When applying PMS and AFA, Korea has differentiated by suggesting countermeasures.
