국문 초록

이 연구는 「청탁금지법」의 입법과 시행을 둘러싼 갈등구조를 정책네트워크 모형에 입각하여 정책 행위자, 정책 행위자 간 상호작용, 정책 이슈 그리고 정책 산출이라는 네 가지 요소로 분석하였다. 정부안의 마련과정에서 중심 정책 행위자는 국민권익위원회, 법무부였다. 도입을 찬성하는 국민권익 위원회, 도입을 반대하는 법무부 간의 갈등은 국무총리 등의 조정을 거쳐 정부안으로 산출되었고, 국회로 정부안이 제출된 이후에는 국회 정무위원회와 법제사법위원회의를 중심으로 대통령과 국무총리 등의 지원을 거쳐 입법이 이루어졌다. 그러나 입법이 이루어진 후에는 당초 입법의 목적이었던 공직자의 이해충돌방지 조항이 사라지고 적용대상으로 광범위하게 민간까지 포함되면서 초기 입법에 찬성한 집단이었던 대한변호사협회와 언론계가 이탈하여 헌법소원을 제기하기도 하였다. 「청탁금지법」은 입법 및 합헌판결이 이루어져 시행되고 있는 현재 시점에도 지속적인 개정 요구 등의 갈등이 나타나고 있기 때문에 장기간에 걸쳐 법의 추진실태를 파악할 필요가 있다.

영문 초록

This study analyzes the dynamics of legislation and the implementation processes of the Improper Solicitation and Graft Act. For this, we utilized a policy network model as a main tool for the analysis. We observed that the dynamics of legislation and implementation processes consist of network actors, policy issue, actor s interaction, relationship structure, and policy outputs. According to this study, the Anti-Corruption and Civil Rights Commission, the Ministry of Justice, and the lawmakers participate in a policy network with the Prime Minister as a key mediation actor. Together, and through diverse interactions, they formed the Improper Solicitation and Graft Act. After the governmental bill was submitted to the Korean Congress, legislation was conducted with support of the president and prime minister. However, after legislation, the subjects of the application were expanded to include not only government officials but also general publics. Since there are demands for revising the Improper Solicitation and Graft Act even after its legislation, it would be necessary to follow up how the law is utilized in practice.
