연명의료결정에 관한 법률 시행과 사목적 제언

국문 초록

“호스피스 · 완화의료 및 임종과정에 있는 환자의 연명의료 결정에 관한 법률(이하 연명의료결정법)”은 임종과정에 있는 환자의 연명의료결정을 제도화 함으로써 환자의 자기결정을 존중하고 환자의 존엄과 가치를 보장함과 동시에 국민 모두가 인간적인 품위를 지키며 편안하게 삶을 마무리할 수 있도록 제정한 것이다. 다시 말하면, 환자가 생의 마지막 순간까지 인간적인 돌봄과 치료를 받을 수 있도록 법적으로 또 사회적으로 제도가 마련된 것이다. 2018 년 2월부터 환자는 연명의료결정법을 통해서 연명의료에 대한 자기결정권을 법적으로 행사할 수 있게 되었고 법의 보호를 받고, 이 법이 정한 원칙에 따라서 환자와 환자 가족 그리고 의료인들은 문서를 작성하고 작성된 문서는 법의 보호를 받게 되었다. 아직 시행 1년이 채 안 되었지만, 사목자는 이러한 법을 잘 알고 있어야 하는 주체이다. 먼저 사목자는 연명의료결정법의 지침을 간략하게라도 설명할수 있는 소양을 갖추어야 한다. 그리고 사목자는 환자와 환자 가족에게 연명 의료결정법이 명시한 범위 안에서 자신의 권리를 행사하고 인격적인 유대 관계 안에서 서로의 권리를 존중할 수 있도록 도와야 한다. 뿐만 아니라 사목자는 의료인들로 하여금 인격적으로 환자를 대하고 존중하도록 하며, 생의 마지막 순간까지 환자가 인간적 돌봄을 받을 수 있도록 의료인들을 격려해야 한다. 또한 사목자는 이 법과 관련된 교회의 가르침(안락사, 인간생명, 환자와 의료 인들을 위한 사목적 동반)을 바탕으로 의료인들과 환자, 환자 가족 간의 관계 에서 있을 수 있는 다양한 문제들을 그들과 함께 고민하고 적절한 방법으로 그들의 판단을 돕고 그들이 진정으로 원하는 도움과 사랑에 충실해야 한다. 아직 연명의료결정법과 관련하여 의료적이고 법적인 문제가 온전히 해소되 었다고 볼 수는 없다. 연명의료결정법의 보완에 대한 지속적인 논의는 지금도 계속되고 있다. 사목자는 가장 가까이에서 환자와 환자 가족, 그리고 의료인을 만나는 주체로서, 중환자와 임종자에 관한 교회의 가르침과 규정을 바르게 인식하고 유연하게 사람들을 만나야 하며, 그들의 양심을 일깨우는 역할을 해야 한다. 동시에 사목자는 현실에서 갖는 연명의료결정법의 한계와 가능성을 주지하는 관찰자가 되어야 한다.

영문 초록

“Act on decisions on life-sustaining treatment for patients in Hospice and palliative care or at the end of life (hereafter “Law on decisions on life-sustaining treatment”) is institutionalized for the purpose of respecting patient’s self-decision, assuring patient’s dignity and also maintaining people’s dignity and could finish his/her life peacefully. In other words, this law institution is prepared for the patient can be treated by personal care and medical treatment lawfully and socially until the end of the life. From February 2018, patient can exercise and be protected his/her self-decision on life-sustaining treatment by this law. According to this law, patient, their family and medical personnel write the Advance (Medical) Directives and this written document can be protected by the law. Less than 1 year has passed since this law enforcement, but the pastor is the subject who should know well about this law. Firstly, the pastor should have knowledge to briefly explain the guideline of this law at least. And the pastor should help patient and families to exercise their rights within specified range of this law, and respect each other’s right within personal relationship. Moreover, the pastor let the medical personnel respect the patient personally and encourage the medical personnel to take care of the patient personally until the end of life. The pastor should agonize the various problems which could arise between medical personnel, patient and families under the base of Church’s teaching related to this law (Euthanasia, Human Life, pastoral accompany for patient and medical personnel), assist their decisions in adequate way, and be faithful wholeheartedly to give them what they truly needed help and love. Until now, medical and lawful problems about this law seem to be not solved thoroughly. Continuous discussions about the supplement of the law are still going on. The pastor is the nearest subject to meet the patient, families and medical personnel, so he should aware the Church’s teaching and regulation on critical patient and dying person rightly, meet the people with pliability and play the role to awake their consciousnesses. And at the same time, the pastor should be the observer to understand the limit and possibility of this law in reality.
