국문 초록

21세기에 접어들면서 우리나라도 급속하게 고령화 사회로 변화하고 있다. 누구든 나이가 들면 병고, 빈곤, 고독, 무위 등 4가지의 고통스런 문제에 직면 하게 된다. 그 동안 노인들은 이러한 문제들을 스스로 해결할 수 있는 적극적 주체라기보다는 소극적 객체로 여겨져 왔다. 노인들도 인간으로서 존엄성을 존중받고 행복하게 살아가기 위한 모든 권리가 보장된다. 따라서 고령화 사회에서는 노인 스스로 보다 독립적이고 자율적인 주체로서 그들의 권리를 실현한다는 적극적인 사고로의 전환이 요구 된다. 그러나 고령화의 추세에 비하면 노인인권에 대한 법적 관심은 미흡한 편이고, 보편적인 인권기준도 확립되지 않은 상태이다. 다행스럽게도 1980년 대부터 국제적으로 노인의 인권 보장과 관련된 국제적 기준과 원칙 또는 행동계획 등이 꾸준하게 발표되어 오고 있다. 이러한 경향에 따라 국내에서도 향후 노인인권에 관련된 법적 관심이 고조될 것으로 예상된다. 본고에서는 노인인권을 위한 국제원칙들에서 강조되고 있는 독립, 참여, 돌봄, 자아실현, 존엄성 등을 중심으로 보편적 인권기준과 관련된 국내법령의 현황을 살펴보고 그 개선방향을 모색해보았다.

영문 초록

In recent years, the number of elderly has been rapidly growing in Korea. Everyone faces with four hardships such as disease, poverty, solitude and inactivity as he gets aged. Generally, the elderly have been regarded as passive objects rather than active subjects that would be competent enough to resolve such problems by themselves. The elderly’s human rights to dignity and happy life as human beings should be respected. In the aging society, the elderly themselves should realize their rights as even more independent and self-supporting individuals. In comparison with the aging trend of modern society, the legal interest in the elderly’s human rights is hardly observed. In addition, no general standards to cope with their human rights have been yet established. Fortunately, since the 1980’s, any relevant international standards and rules as well as action plans for the guarantee of the elderly’s human rights have been constantly announced. Such changes are expected to lead Korea to have a legal interest in the elderly’s human rights. This study is focused on Korean legislation related to independence, participation, caring, self-realization, dignity and others that are being emphasized in the elderly’s human rights.
