상선 선원의 인권보호를 위한 제도 개선 방안에 관한 연구

국문 초록

인간이 사회적으로 지니는 다양한 권리에도 불구하고, 문화적 차이와 갈등으로 인하여 발생하는 선원의 인권 에 관한 담론 형성 및 문제의 제기는 제대로 수행되지 못했다. 승선 중인 선원의 인권문제는 다양한 방면에서 발생하기 때문에 선원인권의 개념은 문자로 정의해야 하는 것이 아니라 선원들이 실제로 생활하는 선상생활 고유의 문제를 확인하고 인권이 침해되는 과정을 분석한 후 정의되어야 하는 것이 바람직하다. 따라서 선원의 인권보호를 위해 일반 조직 문화, 구성원의 실제 현상과 실제 승선생활을 분석할 필요가 있다. 또한 선원들은 ‘ 선박 ’ 이라고 하는 육지와 분리되어 고립된 승선환경과 과거부터 보수적인 관점에서 전해져 온 선상규율이라는 것이 존재하기 때문에 선원의 인권을 보호하기 위해서는 이러한 특성 역시 고려하여 개선방안이 제시되어야 한다. 이러한 관점에서 이 연구는 상선 선원에 대한 승선생활과 문화특성을 분석하고, 승선생활에서 발생하는 다양한 갈등의 문제점을 검토하여 상선 선원의 인권보호를 위한 개선방안을 제시하고자 한다.

영문 초록

Despite the various rights that human beings have as one of the social personality, formalities such as the formation of a discourse about the ‘human rights of seafarers’ arising from cultural differences and conflicts and the raising of problems have not been done properly. In fact, the human rights of seafarers during boarding are not formalized, but seafarers are in conflict with various aspects. In other words, rather than simply defining the concept of the human rights of seafarers in the form of letters, it is a combination of abstract words, rather than defining the concept of the human rights of seafarers who have a unique social life on board. It is desirable to explain the human rights of seafarers based on their characteristics. Therefore, it is necessary to analyze the psychological phenomena of the members in the general organizational culture(from shore based) and the actual situation of the seafarers in order to protect the human rights. In addition, since there are shipboard environment separated from the shore called ‘ship is small society’ and shipboard discipline from the past in a conservative viewpoint, in order to protect the human rights of the seafarers, it is necessary to consider these characteristics and suggest improvement plan. From this point of view, This study analyzes the life style and cultural characteristics of merchant seafarers and review the problems of various conflicts in shipboard life, and suggests improvement measures for the protection of human rights of merchant seafarers.
